Res. 03316-2026 Sala Constitucional · Sala Constitucional · 28/01/2026
The Constitutional Chamber declared, by majority, the unconstitutionality of the 2017-2023 General Management Plan for the Gandoca Manzanillo Wildlife Refuge, published in 2022, for violating articles 50 and 89 of the Constitution and the Ramsar Convention. The Court found that by excluding from its scope the forested area whose delimitation was ordered in judgment 2019-012745, the plan creates uncertainty that prevents effective protection of wetland and forest ecosystems, undermining the preventive and precautionary principles. It also annulled Directive No. 09-2023 of the Ministry of Environment and Energy for stating that the refuge’s boundaries were those of Law No. 9223, disregarding the Chamber’s own partial annulment of that law. The action against the Talamanca-Distrito Cahuita Coastal Regulatory Plan was found inadmissible because the public hearing required for its approval had been previously annulled, depriving it of validity. A third-party motion to clarify the ruling’s effects was dismissed for lacking standing and for seeking legality assessments beyond the Court’s competence. The decision reinforces the State’s duty to demarcate and protect the refuge’s forested areas and wetlands, urging SINAC to comply with the 2019 order.

The Administrative and Civil Treasury Court granted INDER’s lesividad action against the grant of parcel P-218-1 to Cooperativa Coto 63 R.L. The parcel lies entirely within the Golfo Dulce Forest Reserve and is therefore part of the State’s Natural Heritage. The Court held that IDA lacked authority to grant, subdivide, and transfer this public-domain land, and that the 1998 decision had a serious defect in its grounds that resulted in absolute nullity. It rejected the defenses of prescription, expiration, lack of standing, and lack of right, reasoning that the time bars do not apply to this proceeding concerning public-domain property. The Court annulled the 1998 decision insofar as it concerned this parcel, its land registry entry, and its cadastral plan; ordered its physical delivery to MINAE through the Osa Conservation Area; and ordered the Cooperative to pay both categories of costs, with the amount to be determined during enforcement of the judgment.
Res. 01061-2025 Tribunal Agrario · Tribunal Agrario · 07/11/2025
The Agrarian Tribunal hears an appeal from a judgment partially granting an possessory interdict action. The plaintiff, owner of a property under ecological easement in the Playa Tortuga Reserve, alleged that the defendants trespassed, destroyed fences, and damaged the ecosystem. The lower court ordered Jonathan Ian Woods and Ashley Tara Albrand to restore possession and pay costs, but dismissed the claim against Carlos Enrique Guerrero León for lack of proof of acts committed on his own behalf. The Tribunal upholds this finding: evidence showed Guerrero León was an employee of Woods, hired to care for children, and his presence and actions were performed as a worker, without any intent to dispossess for his personal benefit. The passive standing required for the interdict was not established. However, the Tribunal reverses the failure to order Woods and Albrand to pay damages, applying Article 106.5 of the Civil Procedure Code, which mandates such an award in all favorable interdict judgments. The ruling clarifies that the costs award includes both procedural and personal costs.

The Consejo Nacional de Áreas de Conservación validates and approves the 2022–2031 General Management Plan for Corcovado National Park and orders publication of its executive summary and the complete document on SINAC’s institutional website. The plan organizes park management through conservation objectives and terrestrial and marine zoning, with minimum or no, medium, and high intervention zones; the low intervention zone applies only to the marine area. It also identifies forests; rivers, lagoons, and mangroves; certain mammals; and pelagic and coastal marine species aggregation areas as focal management elements. Identified threats include hunting, illegal fishing, gold mining, logging, pollution, and unsustainable tourism practices. The resolution states that it takes effect upon publication in La Gaceta; it does not characterize the plan as a rule of indefinite duration.
The Civil and Labor Appeals Court of Guanacaste upholds the first-instance ruling that granted the interdictal injunction filed by ROMANOR R.M. SOCIEDAD ANÓNIMA against TUANIS GUANACASTE LIMITADA. The claim alleged disturbance of possession due to constructions built by the defendant within a three-meter-wide ecological easement encumbering its property. The appellate court emphasizes the nature of the ecological easement as a continuous, non-apparent real right, whose protection does not require actual possessory acts but only registry inscription. It rejects the grievances regarding improper evidentiary assessment and the alleged need to prove momentary and current possession, noting that the defendant did not deny having carried out the works nor proved they did not affect scenic beauty. The judgment is modified solely to clarify that the awarded sum of ₡1,400,000 corresponds to procedural costs, not attorney fees.
Res. 05089-2023 Tribunal Contencioso Administrativo · Tribunal Contencioso Administrativo · 01/11/2023
The Contentious-Administrative Tribunal dismisses as untimely INDER's lesividad claim seeking to annul the titling of a 76-hectare parcel in Puntarenas. The core reason is that the internal lesividad declaration was issued in 2015—over 14 years after the 2001 segregation and transfer agreement—far exceeding the four-year statute of limitations under the Law Regulating the Contentious-Administrative Jurisdiction, which governs because the act became final before the current procedural code took effect. The court rejects the State's argument that the land constitutes Natural Heritage of the State merely because it lies partly within the Private National Wildlife Refuge "Cataratas de Cerro Redondo."
Res. 06006-2021 Sala Constitucional · Sala Constitucional · 19/03/2021
The Constitutional Chamber reviews an amparo appeal filed by Roger Chávez Monge on behalf of a corporation. The appellant owns a property acquired with a view and ecological easement, whose clauses are deemed harmful to the right to private property and exceed the purpose of ecological easements. It requests the annulment of such limitations to allow full use and enjoyment of the property, including commercial uses. In its reasoning, the Chamber determines that the discussion on the scope or limitations imposed on property by an ecological easement is a matter of ordinary legality and not of constitutional jurisdiction. Therefore, without addressing the merits, it flatly rejects the appeal as manifestly inadmissible, directing the appellant to the ordinary, administrative, or jurisdictional channels to resolve its claims. The resolution concludes by warning the parties about the retrieval of physical documentation.
Decreto Ejecutivo 43334 · 28/10/2021
Executive Decree No. 43334-MINAE repeals Decree No. 18186-MIRENEM of 1988, which had established the Avellana Ranch Wildlife Refuge in Orotina, Alajuela. The repeal was requested by the registered owner, Alejandro Harting González Arellano, who since 2007 has sought the disaffectation of the private refuge, invoking the original decree's clause allowing the owner to change the property's destination with one year's notice. After a favorable legal opinion in 2007 that was not acted upon at the time, and a technical and legal inspection in 2021 recommending the process, the Central Pacific Conservation Area (ACOPAC) of SINAC accepted the request and endorsed the repealing decree. The norm also orders SINAC to coordinate with the National Registry for updated mapping. It takes effect upon publication in La Gaceta, thereby removing the wildlife protection status from the property.

The Attorney General's Office issues a legal opinion on the regime of State Natural Heritage, answering queries from a congresswoman. It analyzes the nature of mixed wildlife refuges and the existence of privately owned properties within protected areas. The opinion concludes that private properties within mixed refuges do not lose their private nature, though they are subject to usage restrictions. It also establishes that areas impacted by human activity cannot be excluded from State Natural Heritage without a disaffection process by law, supported by technical studies, in line with the principle of non-reduction of protected areas. Finally, it outlines the scope of Article 13 of the Forestry Law, defining natural heritage as protected areas and public lands that are forested or of forest aptitude.
The Court dismissed as inadmissible the action seeking to hold the State, the Municipality of Mora, CNFL, and SINAC liable for alleged omissions and environmental damage to the Gingold Family Private Wildlife Refuge. The plaintiff sought compensation for herself based on stormwater runoff, earthworks, pollution of the Pacuaca River, and other impacts, but failed to establish conclusively that she owned the property or administered the refuge. The Court also explained that an individual lacks standing to receive personally the compensation attributable to collective environmental harm. The assertion made at the close of trial—that any award would be used for the refuge—could not transform the originally pleaded individual claim into a collective environmental action because doing so would violate the prohibition against mutatio libelli and the defendants’ right of defense. Any noncompliance with earlier constitutional judgments also had to be pursued through the appropriate judgment-enforcement procedure. The Court therefore did not reach the merits of the alleged environmental damage and ordered the plaintiff to pay all litigation costs.
Res. 12745-2019 Sala Constitucional · Sala Constitucional · 10/07/2019
The Constitutional Chamber denied the challenge to Law No. 9223, which redefined the boundaries of the Gandoca-Manzanillo National Wildlife Refuge to recognize the rights of residents of Costa Rica’s Southern Caribbean region. It found that the technical report included in the legislative process adequately fulfilled its purpose and supported the conclusion that the change would not materially harm ecological balance or the right to a healthy environment. The exclusion sought to adapt the legal regime to settlements and territorial conditions predating the refuge without releasing the affected lands from environmental, forestry, coastal-zone, and biodiversity protections. The Chamber also held that consultation under Article 6 of ILO Convention 169 was unnecessary because the measure did not regulate Indigenous peoples in their collective capacity. It further rejected claims that Costa Rica’s international obligations concerning mangroves and wetlands had been violated because those areas remained protected, and it reiterated the State’s duty to address illegal occupation and construction.
The Contentious-Administrative Tribunal (Section VI) dismisses the lawsuit filed by private landowners within the Gandoca-Manzanillo National Wildlife Refuge (RNVS-GM) against the Comptroller General (CGR), the State, and SINAC. The plaintiffs challenged the validity of CGR reports (DFOE-AE-IF-03-2011 and DFOE-AE-IF-05-2011) ordering the suspension of environmental permits and construction licenses until the Zoning Regulation and Management Plan were adjusted to incorporate the environmental variable, delimit State Natural Heritage (PNE), and protect forest and wetland ecosystems. The court upholds the CGR's actions as valid, reasonable, and necessary under the precautionary principle and the environmental function of property. It rejects the claim that landowners may voluntarily withdraw from the forestry regime, holding that once incorporated into the mixed-nature refuge, a property constitutes a functional environmental unit from which unilateral withdrawal is impermissible. The court notes concern over prolonged delays in implementing the required adjustments and urges authorities to complete them to enable processing of private owners’ applications.
Decreto Ejecutivo 39479 · 10/11/2015
Executive Decree No. 39479-MINAE repeals Decree No. 30883, which had declared the Boracayán Private Wildlife Refuge in the cantons of Pérez Zeledón and Osa. The repeal is based on a SINAC resolution that denied the renewal request submitted by the owner, BORACAYAN del Sur S.A., and ordered the closure of the refuge. The grounds were that four of the fourteen properties comprising the protected area underwent changes in the Property Registry without notification to SINAC, undermining the integrity of the refuge and its conservation objectives. The decree, signed by the President and the Minister of Environment and Energy, orders the repeal and takes effect upon publication.

This executive decree creates the Longo Mai National Wildlife Refuge, a private-category refuge, over 452 hectares owned by ACE Longo Mai, Sociedad de Responsabilidad Limitada, in Buenos Aires de Puntarenas. The declaration responds to a voluntary application by the landowner under Article 82 of the Wildlife Conservation Law, aiming to protect tropical wet forest and premontane rain forest ecosystems that harbor numerous plant and animal species, some endangered. The refuge is established for a ten-year term, automatically renewable for equal periods unless the owner requests declassification three months before expiration. The owner assumes responsibility for administration, monitoring, and maintenance, under the supervision of the La Amistad Pacífico Conservation Area, to which annual reports must be submitted. Any activity threatening flora and fauna is prohibited without SINAC authorization. The decree grants the owner the incentives provided in the Wildlife Law and clarifies that the land remains subject to Forestry Law restrictions and other environmental legislation even after a potential declassification.
Res. 10891-2013 Sala Constitucional · Sala Constitucional · 16/08/2013
The Constitutional Chamber dismisses the amparo filed by the owner of lands within the Punta Río Claro Mixed National Wildlife Refuge, who claimed that SINAC arbitrarily reduced the protected area by declaring the private affectation expired. The Court notes the refuge was created by Executive Decree with a five-year term for private properties, extendable only if all lots were in good legal standing. Since 2000, however, a judicial conflict over ownership of several properties has persisted, and a civil court stated in 2003 that renewal could not proceed until resolved. The Chamber finds no violation of the right to a healthy environment because no environmental harm was proven, and holds that property disputes and technical claims exceed the summary nature of amparo, belonging instead to ordinary jurisdiction.

The refuge aims to conserve natural resources and support research, recreation, ecotourism, and environmental education. Private management is subject to a General Management Plan approved by the National System of Conservation Areas (SINAC). The declaration is valid for five years, renewable by mutual agreement, and is grounded in the Wildlife Conservation Law and the Biodiversity Law.Este decreto ejecutivo crea el Refugio Nacional de Vida Silvestre Lapa Verde, categoría privada, en una finca de 509,5 hectáreas ubicada en Sarapiquí, Heredia. Res. 11102-2011 Sala Constitucional · Sala Constitucional · 19/08/2011
The petitioner, owner of the Familia Gingold Private Wildlife Refuge, filed an amparo against the Municipality of Mora, the National Power and Light Company (CNFL), the Ministry of Public Works and Transport (MOPT), MINAET, and SETENA, arguing that repairs on the public road Calle La Margarita and existing electric wiring caused environmental damages to the refuge through uncontrolled runoff, risk of wildlife electrocution, and fragmentation of a biological corridor. The Court dismisses the amparo as to the wiring: the infrastructure dates from 1985, prior to the refuge’s designation (1998); removing it would cause greater environmental harm and disrupt neighbors’ electricity supply. Regarding the 2011 municipal works—cleaning, ballasting, and pothole patching along the existing alignment—the Court finds that refuge boundaries were respected, hydraulic works are adequate, and a MINAET inspection found no environmental damage. Moreover, the Court holds that the MOPT authorization requirement under Article 2 of the General Public Roads Act is a matter of mere legality, not directly protected by amparo. The appeal is declared without merit on all grounds.
Decreto Ejecutivo 35621 · 24/08/2009
Executive Decree No. 35621-MINAET repeals Decree No. 23147-MIRENEM which established the Finantica Private Wildlife Refuge in 1994 on approximately 15 hectares of property registered under Folio Real 217331-000, owned by Finantica S.A. The repeal is based on the fact that the first decree (No. 23124) had already been revoked in 1999 at the owner's request, rendering the second decree (No. 23147) legally void. Furthermore, the current owner, Condominio Eco Residencial Villa Real, formally requested cancellation of the refuge designation. The decree disaffects the property from the private wildlife refuge regime and explicitly repeals the founding decree, thereby freeing the land from the restrictions associated with this voluntary conservation category.

The Constitutional Chamber dismisses an unconstitutionality action brought by the mayor of Talamanca against several executive decrees governing the Gandoca-Manzanillo National Wildlife Refuge. The petitioner argued that the refuge's creation and modifications violated municipal autonomy, private property, and the normative hierarchy because the local government was not consulted and owners were not compensated. The Chamber holds that the Executive Branch has exclusive competence to establish and manage protected areas, with no duty to consult municipalities, as environmental protection is a matter of national interest that overrides local concerns. Issues regarding compensation and compliance with statutory requirements are deemed matters of ordinary legality and are remitted to the contentious-administrative jurisdiction. Regarding boundary changes, the Chamber reiterates that the Executive may not reduce protected areas but may expand them; thus Decree 32753-MINAE, which reincorporated urban zones into the refuge, is constitutional. The action is mostly dismissed outright and on the merits with respect to that decree.

This Procedures Manual, issued by FONAFIFO's Board of Directors in 2005 (with subsequent reforms), establishes the technical, administrative, and legal mechanisms for managing Costa Rica's Payment for Environmental Services (PSA) Program. It regulates application procedures, prioritization, contracting, payments, and monitoring for the modalities of forest protection, reforestation, and planting trees in agroforestry systems (SAF). It defines eligibility criteria for beneficiaries (individuals or legal entities, owners, tenants, and possessors), legal requirements for properties, obligations of forest regents and organizations, and the minimum and maximum areas and amounts. The document links the PSA program with Forestry Law No. 7575 and the executive decrees that set annual amounts, prioritizing geographic areas (biological corridors, zones with low social development index) and certain types of projects, serving as the program's fundamental operational guide.

Res. 03480-2003 Sala Constitucional · Sala Constitucional · 02/05/2003
The Constitutional Chamber denied the challenge to the Playa Platanares Coastal Tourism Sector Regulatory Plan because the available evidence did not establish with certainty that it overlapped the Preciosa-Platanares National Wildlife Refuge. A GPS survey indicated a possible overlap, but its margin of error could exceed the allegedly encroached area. The Chamber distinguished uncertainty about whether a risk-generating fact exists from scientific uncertainty about that fact’s environmental effects: the precautionary principle applies in the latter situation, where the fact is known but its harmfulness remains uncertain. It does not permit a restriction based solely on uncertain data about whether the underlying event occurred. Nevertheless, the Chamber ordered the Ministry of Environment and Energy to conduct suitable topographic studies within three months to determine whether the overlap existed. If an invasion of the protected area was confirmed, the Ministry was required to use all legally available means to recover the affected land promptly and effectively.
This regulation establishes zoning and land-use rules for the Gandoca-Manzanillo National Wildlife Refuge (RNVS-GM), a mixed protected area with over 85% private ownership. It divides the refuge into 15 zones (9 terrestrial and 6 marine-coastal), each with recommended uses, conditional uses, and prohibited uses based on technical land-suitability and sustainability criteria. It sets restrictions for construction (heights, setbacks, coverage), tourist infrastructure, agricultural activities, fishing, and wetland protection, among others. It includes an enforcement regime.

The Attorney General's Office (PGR) resolves the dispute between FONAFIFO and the Public Registry regarding the duration and registration annotation of environmental services payment (PSA) contracts. It concludes that the minimum 20-year term under Articles 22 and 24 of the Forestry Law applies only to the Forest Conservation Certificate (CCB). For other PSA modalities under Articles 46 and 69, the terms are set by executive decrees: 5 years for forest protection, 10 years for forest management, and for reforestation, the harvest period up to a maximum of 15 years. The PGR holds that the Executive Branch has the authority to set these terms by regulation, and that registration annotation is mandatory for all PSA contracts as an incentive administered by FONAFIFO.La Procuraduría General de la República (PGR) aclara la disputa entre FONAFIFO y el Registro Público sobre el plazo de vigencia y afectación registral de los contratos de pago de servicios ambientales (PSA).
Res. 08097-2001 Sala Constitucional · Sala Constitucional · 10/08/2001
The Constitutional Chamber dismissed the amparo filed by property owners whose lands fall within the boundaries of the Limoncito National Wildlife Refuge. The claimants sought expropriation by the Ministry of Environment and Energy (MINAE). The Chamber found no violation of the right to property (Article 45 of the Constitution) because the owners retained full dominion attributes, and MINAE had not initiated any expropriation process nor demonstrated any state interest in acquiring the properties. Relying on Article 37 of the Environmental Organic Law, the Chamber held that private lands are only incorporated into state-protected wild areas after lawful purchase or expropriation, unless voluntarily submitted to the Forest Regime. The ruling clarifies that mere geographic overlap with a refuge does not constitute a limitation on property rights, and noted that the claimants' failure to pursue ordinary judicial remedies contributed to their predicament.

Ley 7575 · 13/02/1996
The Forestry Law (No. 7575) establishes the legal framework for the conservation, protection and management of natural forests and the promotion of forest resources in Costa Rica. It defines key concepts such as forest, forest plantation, forest ecosystem and environmental services. It declares the State's essential function to ensure the adequate and sustainable use of forest resources, prohibiting land-use change in forest-covered land (Art. 19) and requiring management plans for their exploitation. It creates the Forest Fund and the National Forest Financing Fund to finance conservation, reforestation and payment for environmental services programs. It imposes a 3% tax on timber and defines incentives such as the Forest Conservation Certificate (CCB). In addition, it criminalizes offenses against forest resources, including invasion of protected areas, illegal logging, forest fires and land-use change, with prison sentences and seizure of products. The law is of public order and repeals previous legislation, consolidating the Costa Rican forest regime.
C-336-2006 · 23/08/2006
The National Forestry Office inquired whether the National Forestry Financing Fund (FONAFIFO) may encumber private properties enrolled in the Environmental Services Payment (PSA) program on the Public Property Registry. The Attorney General’s Office reaffirms the criterion of opinion C-038-2002 and concludes that PSA is a forestry incentive; therefore, under Article 49 of the Forestry Law, all registered properties or those with registrable title that join the program must be encumbered. The encumbrance aims to publicize the contract to third parties and safeguard the State's (FONAFIFO’s) rights in the event of transfers or subdivisions. The Office rejects the argument that encumbrances discourage reforestation, noting that the decline stems from multiple factors and that demand for PSA actually exceeds supply. It further holds that exempting some programs from encumbrance would violate the constitutional principle of equality and that the measure is suitable for protecting the right to an ecologically balanced environment enshrined in Article 50 of the Constitution.
OJ-022-2008 · 22/05/2008
The Office of the Attorney General analyzes the substitute text of the bill 'Promotion of Conservation on Private Lands' (legislative file 14.924), which regulates ecological easements, private natural reserves, and private natural monuments. The opinion notes that the project lacks integration with other in situ and ex situ conservation forms and does not consider existing figures in the Forestry Law such as voluntary submission to the forestry regime. It criticizes that the text does not adequately differentiate the legal regimes of the three figures, and points out inaccuracies in definitions like 'ecological easement', 'management plan', and 'natural coverage area', which should be 'forest coverage'. The territorial restriction for ecological easements in Article 4, the perpetuity of contracts, the lack of distinction between contractual breach and legal violation, and the need to clarify verification powers and procedural avenues are questioned. The PGR suggests simplifying the project as amendments to existing laws or integrating it into a comprehensive protected areas law.
C-219-2012 · 20/09/2012
The Attorney General's Office responds to SINAC's query on whether forest harvesting permits in Mixed Wildlife Refuges require an Environmental Impact Assessment (EIA) and whether Article 5 of Decree 34559-MINAET contravenes Articles 82 of the Wildlife Conservation Law, 114 of the Biodiversity Law, and 17 of the Environmental Law. The opinion concludes that, although the regulations do not explicitly list forest harvesting among the permitted activities in the private portion of these refuges, if it is exceptionally authorized under SINAC's compatibility criterion, a prior EIA is required under Article 82 of Law 7317. It also finds that Article 5 of Decree 34559 conflicts with that law and Articles 17 and 37 of the Environmental Law by establishing that environmental viability is obtained after the management plan is approved, whereas the law requires the impact evaluation to be prior to authorization.
C-270-2017 · 16/11/2017
The Procuraduría rejects as untimely and inadmissible the request to reconsider opinions C-038-2002 and C-336-2006, which established the duty to register all properties under the payment for environmental services program as an encumbrance. It also declares inadmissible the inquiry regarding the ONF legal advisor's opinion on timber harvesting in protected areas, while noting that amendments to the Wildlife Conservation Law do not alter the requirement for environmental impact assessments in mixed wildlife refuges, and that forest activities there are only permissible if the management plan authorizes them.

The Attorney General's Office analyzes whether the private area within a mixed wildlife refuge can be withdrawn by executive decree or if Article 38 of the Environmental Organic Law, requiring a law for the reduction of protected wild areas, must be applied. It concludes that in refuges created unilaterally by the Executive Branch, both the public and private areas may only be reduced by law, with prior technical studies and compensation. Exceptionally, if the refuge was created at the voluntary request of the owners and a term was set for the private portion's subjection, upon expiration of that term the private area may be excluded without a law, while maintaining protection over the state area. The opinion is based on the ecological unity between the public and private areas and on constitutional jurisprudence that extends the legal reserve requirement to any reduction of a protected wild area.
