Pursuant to the non-regression principle, environmental norms and jurisprudence must not be revised if doing so would retreat from the level of protection already achieved. This prevents protective norms from being suppressed or weakened for interests that have not shown themselves legally superior to the public environmental interest, since such regressions most often cause irreversible or difficult-to-repair environmental damage. Existing protection standards must not be impaired, nor current norms repealed or modified, where that would diminish or otherwise negatively affect the current level of environmental protection. In this matter, the path is forward, never backward.De conformidad con el principio de no regresividad, la normativa y la jurisprudencia en materia ambiental, no debe ser revisada, si con ello se retrocede en relación con el nivel de protección que ya se había alcanzado en la materia. Con esto, se evita la supresión de la normativa proteccionista o la reducción de sus exigencias por intereses contrarios a ella que no demuestren ser jurídicamente superiores al interés público ambiental, pues en la mayoría de las veces, esas regresiones en la protección al ambiente, tienen como consecuencia daños ambientales irreversibles o de difícil reparación. De modo tal, que no se ha de afectar los estándares de protección ambiental ya alcanzados, ni derogar o modificar la normativa vigente si con ello se produce una disminución, menoscabo o cualquier otra forma de afectación negativa al nivel actual de protección del ambiente. Removal of Border-Zone Protection Without Technical StudiesDesafectación de la franja fronteriza sin estudios técnicos

The Constitutional Chamber held that the bill seeking to remove public-domain protection from, and grant title over, land along the Costa Rica–Panama border was unconstitutional. The proposed removal of protection was generic and unsupported by technical studies identifying the affected parcels or assessing their environmental, forestry, strategic, and Indigenous characteristics. This omission constituted an essential defect in the legislative procedure and violated constitutional Article 50 and the precautionary, environmental non-regression, environmental objectification, reasonableness, and proportionality principles. The Chamber emphasized that the bill could diminish the State Natural Heritage, permit private appropriation of public-domain property, and affect forests, forest lands, and Indigenous territories. It also found a substantive constitutional defect in Article 1 because removing the border zone from the public domain was contrary to the constitutional principles of national security and sovereignty. The Chamber deemed it unnecessary to decide the remaining issues raised in the consolidated legislative consultations.La Sala Constitucional determinó que el proyecto de ley para desafectar y titular terrenos de la franja fronteriza entre Costa Rica y Panamá era inconstitucional. La desafectación se planteaba de forma genérica, sin estudios técnicos que identificaran los terrenos afectados ni evaluaran sus condiciones ambientales, forestales, estratégicas o indígenas. Esa omisión constituía un vicio esencial del procedimiento legislativo y vulneraba el artículo 50 constitucional y los principios precautorio, de no regresividad ambiental, objetivación de la tutela ambiental, razonabilidad y proporcionalidad. La Sala destacó que la iniciativa podía reducir el Patrimonio Natural del Estado, permitir la apropiación privada de bienes demaniales y afectar bosques, terrenos forestales y territorios indígenas. También concluyó que el artículo 1 era inconstitucional por razones de fondo, pues la desafectación comprometía los principios constitucionales de seguridad y soberanía. Consideró innecesario resolver los restantes cuestionamientos planteados en las consultas legislativas acumuladas.

This executive decree establishes an import quota mechanism for the gradual reduction of hydrofluorocarbons (HFCs) in Costa Rica, in accordance with the Kigali Amendment to the Montreal Protocol. The Environmental Quality Management Directorate (DIGECA) of MINAE is responsible for calculating and assigning annual quotas to registered importers, based on a national baseline and a schedule of progressive reductions: 10% by 2029, 30% by 2035, 50% by 2040, and 80% from 2045 onward. The regulation creates a state reserve fund of 12% of the national quota to address critical uses and new importers, and prohibits domestic production of HFCs. Violations are penalized under the Environmental Organic Law.Este decreto ejecutivo establece un mecanismo de cuotas de importación para la reducción gradual del uso de hidrofluorocarbonos (HFC) en Costa Rica, de conformidad con la Enmienda de Kigali al Protocolo de Montreal. The Attorney General's Office issues its opinion on the bill 'Law for the rescue of legitimate rights of citizens in border areas' (file 16347). It finds the bill unconstitutional, relying on the recent Constitutional Chamber ruling 18836-2014 on a similar bill. It notes that the proposal to disaffect the two-kilometer strip along the borders with Nicaragua and Panama to grant titles to occupants lacks prior technical studies identifying the specific lands affected, endangering the Nation's Natural Heritage and violating Article 50 of the Constitution, the precautionary principle, in dubio pro natura, and non-regression. The subcommittee draft allowed establishing rights-of-way in protected areas subject to environmental feasibility and MOPT-MINAE agreement, and exempted permits for minor watercourse works. The PGR warns of unconstitutionality for violating preventive, non-regression, and environmental protection objectification principles, given lack of prior technical studies to justify reduced protection and the threat to State Natural Heritage. It concludes that approval is a legislative policy decision.La Procuraduría General de la República examina el proyecto de ley 19899 que buscaba adicionar artículos a la Ley General de Caminos Públicos para flexibilizar exigencias ambientales en la construcción y mantenimiento de carreteras. Without sufficient technical studies justifying the measure, the repeal would violate the principle of non-regression in environmental matters, recognized by constitutional case law, and could therefore be unconstitutional.La Procuraduría analiza el proyecto de derogatoria del artículo 69 de la Ley de Aguas (No. 276), que define zona marítima, cauce, álveo y vaso. Concluye que la norma sigue siendo aplicada por los tribunales —como lo demuestran resoluciones del Tribunal Agrario, la Sala Primera y la Sala Constitucional— y que su derogación afectaría la aplicación de múltiples disposiciones conexas, incluyendo normas sancionatorias de la Ley Forestal (Arts. 33, 34, 58) y de la Ley de Conservación de la Vida Silvestre (Arts. 100, 128). Sin estudios técnicos suficientes que justifiquen la medida, la derogatoria violaría el principio de no regresión en materia ambiental, reconocido por la jurisprudencia constitucional, por lo que podría ser inconstitucional.

Compensation for Protected Areas and Wetlands — Validity RequirementsCompensación de áreas silvestres protegidas y humedales — requisitos de validez

Examines the feasibility of compensating the reduction of a protected wild area (ASP) or wetland with lands located elsewhere, by paying for properties within an ASP pending expropriation, or by changing the management category of adjacent state lands. Concludes that compensating with lands already within the boundaries of an ASP (even if not yet paid) is invalid, as it implies a net decrease of the protected area. Compensation in a different site is acceptable if the land has the same environmental attributes and management category, supported by sufficient technical studies as the only alternative, and respecting the principle of non-regression. Regarding wetlands, the ecosystem itself cannot be reduced, but the limits of an ASP containing it can be modified or it can be removed from the State's natural heritage, subject to the same requirements.Analiza si es factible compensar la reducción de un área silvestre protegida (ASP) o humedal con terrenos en otro lugar, pagando propiedades dentro de un ASP pendientes de expropiación o mediante cambio de categoría de manejo de terrenos estatales adyacentes. Concluye que la compensación con terrenos ya comprendidos en los límites de un ASP (aunque no hayan sido pagados) no es válida, porque implicaría una disminución neta del área protegida. Admite la compensación en otro sitio si el terreno posee los mismos atributos ambientales y categoría de manejo, siempre que existan estudios técnicos que lo justifiquen como única alternativa y se respete el principio de no regresión. Se acoge la excepción de falta de derecho y se condena a la actora al pago de costas.

Expropriation of Properties Within Las Baulas National ParkExpropiación de fincas dentro del Parque Las Baulas

The Administrative Litigation Court partially granted Grande Beach Holdings’ claim against the State because of the unjustified delay in consolidating Las Baulas Marine National Park through the expropriation of private land. The Court found it unacceptable that the proceedings remained unfinished more than thirty-three years after the park was created, particularly in light of a binding Constitutional Chamber precedent requiring their prompt processing. It ordered the Executive Branch, within three months after the judgment becomes final, to process a declaration of public interest and notify the company of the administrative appraisal for seven properties located wholly or partly inside the park. If the appraisal is contested, MINAE, acting through the Attorney General’s Office, must promptly commence judicial expropriation proceedings to determine just compensation. No compensation may be awarded for land within the maritime-terrestrial zone, State Natural Heritage, or property unlawfully removed from the public domain. All remaining claims were denied, and each party must bear its own costs.El Tribunal Contencioso Administrativo acogió parcialmente la demanda de Grande Beach Holdings contra el Estado por la demora injustificada en consolidar el Parque Nacional Marino Las Baulas mediante la expropiación de terrenos privados. Consideró inaceptable que, más de treinta y tres años después de la creación del parque, no hubieran concluido los procedimientos, especialmente ante el precedente vinculante de la Sala Constitucional que ordenó tramitarlos con celeridad. Dispuso que el Poder Ejecutivo, dentro de los tres meses siguientes a la firmeza, tramite la declaratoria de interés público y comunique el avalúo administrativo correspondiente a siete fincas total o parcialmente ubicadas dentro del parque. Si se impugna el avalúo, el MINAE, por medio de la Procuraduría, deberá promover rápidamente el proceso expropiatorio para fijar el justiprecio. No procede indemnizar áreas pertenecientes a la zona marítimo-terrestre, al Patrimonio Natural del Estado o sustraídas ilegalmente del dominio público. The Administrative Litigation Court found that the Laguna Pochotal Wetland had deteriorated because of human actions and omissions, including drainage channels, fills, and stream alterations that disrupted its natural water flows. It also found that technical recommendations for diagnosing, protecting, and restoring the ecosystem had not been implemented in a timely and adequate manner. The Court therefore partially granted the claim against the State and SINAC, ordering them to adopt measures and planning instruments to prevent and combat pollution and degradation of the wetland in coordination with the Municipality of Garabito and SETENA. Their response must include an updated environmental impact assessment and a work plan or environmental matrix specifying the required actions, participating institutions, responsible units, and commencement and completion deadlines for effective restoration. MINAE and SINAC must submit progress and implementation reports every six months throughout enforcement. The First Chamber denied the cassation appeal filed by two companies whose properties lie wholly or almost wholly within Laguna Bonilla Wetland or its protection zone. It held that an environmental designation, standing alone, does not establish that the essential attributes of private property have been extinguished or require the State to expropriate or compensate the owners. Certain works or activities may be authorized in wetlands when consistent with rational use and applicable environmental law; consequently, the designation does not automatically prohibit every economic use. One company proved only that the municipality had denied permission for a bus parking facility, not that every compatible project had been rejected. The other failed to identify sufficient evidence of applications for permits that authorities had denied. The companies also failed to prove loss of market value, damages, causation, or an absolute inability to use the land. The burden of proving the alleged de facto expropriation rested on the claimants.La Sala Primera rechazó el recurso de casación interpuesto por dos sociedades cuyas fincas están total o casi totalmente comprendidas en el Humedal Laguna Bonilla o en su zona de protección. Confirmó que esa afectación ambiental, por sí sola, no demuestra el vaciamiento de los atributos esenciales de la propiedad privada ni obliga al Estado a expropiar o indemnizar. Según la Sala, en los humedales pueden autorizarse determinadas obras o actividades compatibles con su uso racional y sujetas a la normativa ambiental, por lo que no existe una prohibición automática de toda utilización económica. Una sociedad únicamente acreditó la denegatoria municipal de un parqueo para buses, no el rechazo de cualquier proyecto compatible; la otra no identificó prueba suficiente de permisos solicitados y denegados. Tampoco se probó pérdida de valor comercial, daños, nexo causal ni imposibilidad absoluta de aprovechar los inmuebles. La carga de demostrar la alegada expropiación de hecho correspondía a las actoras.

Mandatory Protection of Endangered Hammerhead SharksProtección obligatoria del tiburón martillo en peligro de extinción

The First Chamber partially granted the cassation appeal against the judgment that had dismissed the action seeking protection for three hammerhead shark species. It held that INCOPESCA measure AJDIP/290-2017, which classified them as being of fishing and commercial interest, was contrary to the legal system and absolutely null because of its deficiencies and its connection to a previously annulled decree. Relying on technical and scientific criteria, the Chamber recognized the Sphyrna genus as endangered wildlife legally subject to the public domain. It explained that inclusion of a species in CITES Appendix II does not prevent Costa Rica from granting stricter domestic protection. The Chamber also criticized the authorities’ inaction despite the populations’ critical condition and applied the precautionary, preventive, non-regression, and environmental progressivity principles. It ordered the three species added to the national endangered-species list and directed SINAC, INCOPESCA, and the State to take all necessary and appropriate measures to eradicate their capture, retention, sale, and landing.La Sala Primera declaró parcialmente con lugar el recurso de casación contra la sentencia que había rechazado la demanda para proteger tres especies de tiburón martillo. Determinó que el acto AJDIP/290-2017 de INCOPESCA, que las declaró de interés pesquero y comercial, era contrario al ordenamiento jurídico y absolutamente nulo por sus deficiencias y por su conexión con un decreto previamente anulado. La Sala reconoció al género Sphyrna como vida silvestre en peligro de extinción, sujeto al dominio público, con fundamento en criterios técnicos y científicos. Señaló que la inclusión de una especie en el Apéndice II de CITES no impide que Costa Rica le otorgue una protección nacional más rigurosa. Ordenó incorporar las tres especies en la lista nacional de especies en peligro de extinción y adoptar medidas para erradicar su captura, retención, comercialización y descarga.

Although the procedural disposition prevented the company from obtaining relief, the Court examined the relevant protection regimes. It held that Article 31 of the Water Law did not apply because the springs lacked drinking-water intake infrastructure, an essential condition for the 200-meter public-domain reservation. Nevertheless, it explained that Articles 33 and 58 of the Forestry Law protect the environment comprehensively, including the ecosystems and water and forest resources surrounding springs, even on private property and in urban areas. Consequently, a favorable SENARA study concerning contamination risks or groundwater flow paths does not automatically displace the statutory protection radius. Determinó que el artículo 31 de la Ley de Aguas no regía porque las nacientes carecían de una toma surtidora de agua potable, requisito para la reserva de dominio público de doscientos metros. No obstante, explicó que los artículos 33 y 58 de la Ley Forestal protegen integralmente el ambiente, incluidos los ecosistemas y los recursos hídrico y forestal alrededor de las nacientes, aun en propiedad privada y zonas urbanas. Por ello, un estudio favorable de SENARA sobre contaminación o tubos de flujo no elimina automáticamente el radio legal de protección. The Chamber concluded that “forest lands” is not synonymous with “forests” and may encompass lands classified as suitable for forestry under the official methodology, including classifications based on biological or ecological criteria rather than solely on steep slopes. It therefore upheld the Administrative Litigation Court’s interpretation and found sufficient legal grounds for treating such lands as part of the protected category. The Chamber also rejected documentary evidence submitted during cassation because it did not concern new facts arising after the challenged judgment. Consideró jurídicamente válida la interpretación del Tribunal Contencioso Administrativo y determinó que existía motivo suficiente para incluir esos terrenos dentro de la categoría protegida. También rechazó la prueba documental aportada en casación porque no versaba sobre hechos nuevos posteriores a la sentencia. En consecuencia, desestimó todos los agravios, mantuvo el rechazo de la demanda y condenó a las recurrentes al pago de las costas del recurso.

Annulment of the Tivives Protected Zone ReductionAnulación de la reducción de la Zona Protectora Tivives

The Constitutional Chamber granted the challenge against Executive Decree No. 42404-MINAE, which had excluded approximately 81.9 hectares from the Tivives Protected Zone under the guise of correcting its boundaries. Furthermore, for the self-consumption regime, the restriction imposed by executive decree breaches the reserve of law and freedom of enterprise. La Sala aclara que la regulación del GNL en régimen de servicio público no resulta inconstitucional, dado que esa actividad está reservada al Estado y sujeta a una regulación más intensa.

Consideró que el decreto no regula el registro de nuevos plaguicidas, sino la actualización de la información de productos ya registrados y comercializados, para ordenar el sistema de registros, acabar con la vigencia indefinida y obtener información química confidencial sobre impurezas. Rechazó que la exclusión de los Ministerios de Salud y Ambiente en la suscripción o en el trámite de actualización configure una lesión constitucional, pues la Ley de Protección Fitosanitaria concentró la competencia de inscripción en el SFE, sin perjuicio de las amplias facultades de esos ministerios para fiscalizar y adoptar medidas precautorias. Tampoco encontró vicios en los plazos, requisitos o uso de información referenciada, remitiéndose en este último punto a la sentencia n.°2022-26651 que avaló el uso de información de otras autoridades conforme a estándares internacionales. Afirmó que el principio precautorio obliga a las autoridades a actuar ante riesgos ciertos, reales e inminentes, incluso sobre productos registrados.

By majority, the Chamber denied the constitutional challenge, but preserved the provisions only through a constitutionally compliant environmental interpretation. Productive needs, plant inventories, and a sworn statement are insufficient by themselves: before authorizing fishing, INCOPESCA must possess reliable and current technical-scientific studies capable of assessing the conservation of tuna and other living resources, preventing overexploitation, and defining appropriate permit conditions. The ruling recognizes Costa Rica’s sovereign authority to regulate and use living resources within its exclusive economic zone, while subjecting that authority to preventive, precautionary, and science-based environmental safeguards. La decisión reconoce la potestad estatal de ordenar y aprovechar los recursos de la zona económica exclusiva, pero somete su ejercicio a los principios preventivo, precautorio y de objetivación de la tutela ambiental. Unconstitutionality of Moratorium on Occupations in Special AreasInconstitucionalidad de la moratoria sobre ocupaciones en zonas especiales

The Constitutional Chamber struck down Law No. 9073 in its entirety. That law had imposed a twenty-four-month suspension of evictions, demolitions, and the shutdown of activities or projects in the maritime-terrestrial zone, the border zone, and the State Natural Heritage. The judgment concludes that this general moratorium weakened the protection of public-domain property closely connected to the right to a healthy and ecologically balanced environment. The law treated lawful and unlawful occupants alike, even where the latter had entered without authorization, built without permits, or caused environmental harm, thereby violating the principle of equality. The Chamber also rejected the proposition that human sustainable development could justify such an indiscriminate suspension. In annulling the whole law, the Chamber gave its judgment declaratory and retroactive effect from the date the provisions entered into force, while preserving rights acquired in good faith and legal relationships or situations consolidated through prescription, expiration of claims, or a final judgment having substantive res judicata effect.La Sala Constitucional declaró inconstitucional la totalidad de la Ley N.º 9073, que suspendía durante veinticuatro meses los desalojos, las demoliciones y la paralización de actividades o proyectos en la zona marítimo terrestre, la zona fronteriza y el Patrimonio Natural del Estado. The Chamber analyzed the claims in two groups: violations arising from the mere promulgation (damage to the waste management design, disregard of international obligations, violation of the principles of objectivation and non-regression, lack of trained professionals) and violations from specific provisions (lack of regulation of hazardous waste, final products, safety distances, permit deadlines). It concluded the decree does not contradict the Integrated Waste Management Law (8839), respects the hierarchy (reduce, reuse, recycle, and only subsidiarily permits co-incineration), is compatible with international treaties, and does not breach environmental principles. The action was dismissed, as the decree established sufficient regulations and the arguments lacked technical substantiation to prove unconstitutionality. One judge added a note stating the regulation is at the limit of what is admissible and future application could raise new questions.La Sala Constitucional rechaza una acción de inconstitucionalidad contra el Decreto Ejecutivo 39136-S-MINAE, que regula las condiciones de operación y control de emisiones de instalaciones de coincineración de residuos sólidos ordinarios. Los accionantes alegaban que el decreto violaba el derecho a un ambiente sano (Art. 50 Constitución), principios ambientales y obligaciones internacionales, al autorizar una actividad riesgosa y desincentivar el manejo integral de residuos. La Sala analizó los reclamos en dos grupos: infracciones por la mera promulgación (lesión al diseño de manejo de residuos, irrespeto de obligaciones internacionales, violación de principios de objetivación y no regresión, falta de profesionales capacitados) e infracciones por disposiciones específicas (falta de regulación de residuos peligrosos, productos finales, distancias de protección, plazos para permisos). Concluyó que el decreto no contradice la Ley de Gestión Integral de Residuos (8839), respeta la jerarquización (reduce, reutiliza, recicla, y solo subsidiariamente permite coincineración), es compatible con los convenios internacionales y no quebranta los principios ambientales. Declaró sin lugar la acción, considerando que el decreto establece regulaciones suficientes y los argumentos carecían de fundamentación técnica para acreditar la inconstitucionalidad. Un magistrado añadió nota señalando que la normativa está en el límite admisible y que la aplicación futura podría suscitar nuevos análisis.

Reducing Protected Areas Requires an Adequate Technical StudyReducción de áreas protegidas exige estudio técnico suficiente

The Constitutional Chamber found the Recognition of the Rights of the Inhabitants of the Southern Caribbean bill unconstitutional because of an essential defect in the legislative procedure. The bill sought to remove the Cocles-Manzanillo coastal plain from the Gandoca-Manzanillo National Wildlife Refuge, but it lacked the specific, comprehensive, and scientifically grounded technical study required by Article 38 of the Organic Environmental Law. The supporting documents did not adequately assess the effects of removing protection on marine and inland areas, reefs, aquifers, Ramsar wetlands, the biological corridor, wildlife, or the refuge’s overall ecological balance. The Chamber explained that the legislature may reduce a protected area only after materially demonstrating the measure’s environmental viability, its impacts, and the corresponding mitigation measures. Because the study contained evident omissions and the record lacked sufficient scientific evidence, the Chamber applied the precautionary principle and held that the bill violated Article 50 of the Constitution.La Sala Constitucional determinó que el proyecto de Ley de Reconocimiento de los Derechos de los Habitantes del Caribe Sur era inconstitucional por un vicio esencial del procedimiento legislativo. El proyecto pretendía excluir la llanura costera Cocles-Manzanillo del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, pero no estaba respaldado por el estudio técnico específico, integral y científicamente fundado que exige el artículo 38 de la Ley Orgánica del Ambiente. Los documentos aportados no evaluaban adecuadamente los efectos de la desafectación sobre las zonas marinas y continentales, los arrecifes, acuíferos, humedales Ramsar, el corredor biológico, la vida silvestre ni el equilibrio general del refugio. La Sala explicó que el legislador puede reducir un área protegida, pero únicamente después de demostrar materialmente la viabilidad ambiental de la medida, sus impactos y las medidas de mitigación correspondientes. Ante las omisiones manifiestas y la falta de evidencia científica, aplicó el principio precautorio y declaró infringido el artículo 50 constitucional.

Satellite Monitoring Exemption for Fishing Vessels Lacking Adequate Technical JustificationExención de monitoreo satelital pesquero sin motivación técnica suficiente

The Constitutional Court heard an amparo petition from a fishing boat captain in Puerto Jiménez challenging INCOPESCA Agreement AJDIP-162-2024, which repealed the transitional provision that would have made GPS satellite tracking (VMS/AIS) mandatory for mid-scale tourist and sport fishing vessels. The petitioner alleged violation of the constitutional right to a healthy environment (Art. 50) and of the non-regression principle in environmental law. The Court partially granted the amparo solely against INCOPESCA, finding the agency failed to provide sufficient technical justification showing that the repeal preserved the existing level of environmental protection. INCOPESCA's executive president was ordered to complete the technical motivation or issue a new duly motivated agreement within six months. The amparo was denied as to MOPT and the Coast Guard, which lacked regulatory authority over satellite monitoring of fishing vessels.La Sala Constitucional conoció un recurso de amparo interpuesto por un capitán de embarcación de Puerto Jiménez, quien impugnó el acuerdo AJDIP-162-2024 del INCOPESCA, mediante el cual se derogó el Transitorio II que obligaría a las embarcaciones de pesca turística y deportiva de mediana escala a instalar dispositivos de localización satelital (VMS/AIS). El recurrente alegó violación del derecho a un ambiente sano (artículo 50 constitucional) y del principio de no regresión ambiental. La Sala declaró parcialmente con lugar el amparo únicamente frente al INCOPESCA, al constatar que la institución no aportó motivación técnica suficiente que demostrara que la derogatoria preservaba el nivel de protección ambiental previamente alcanzado. Ordenó al Presidente Ejecutivo completar dicha motivación o emitir un nuevo acuerdo debidamente fundamentado en seis meses. El recurso se declaró sin lugar respecto del MOPT y el Servicio Nacional de Guardacostas, por carecer de competencia reglamentaria en la materia.

200-meter protection zone for public drinking water supply wellsProtección de 200 metros de radio para pozos de abastecimiento público

Amparo filed by residents of San Rafael de Heredia against the Municipality, SENARA, AyA (ICAA), and the MINAE Water Directorate, arising from construction of a subdivision adjacent to Pozo La Meseta (BA-689), a drinking-water well serving approximately 32,000 people. The case exposed an inter-institutional conflict: SENARA and AyA argued for a 200-meter protection zone under Article 31 of the Water Law, while the MINAE Water Directorate held that only the 40-meter operational setback (ROP) under Decree 43053-MINAE applied. The Constitutional Chamber applied the precautionary principle and SENARA's binding authority under Article 3(h) of Law 6877 to adopt the broader 200-meter criterion. Finding that authorities had failed to act despite repeated complaints since 2023 and detection of fecal coliforms near the well, the Court granted the amparo and ordered immediate provisional measures, creation of an interinstitutional coordinating body within five days, and a comprehensive protection plan within one month.Amparo interpuesto por vecinos de San Rafael de Heredia contra la Municipalidad, el SENARA, el ICAA y la Dirección de Aguas del MINAE, por la construcción de un fraccionamiento contiguo al Pozo La Meseta (BA-689), fuente de agua potable para aproximadamente 32.000 personas. El caso expuso un conflicto interinstitucional: el SENARA y el AyA sostenían que el pozo requería una zona de protección de 200 metros conforme al artículo 31 de la Ley de Aguas, mientras que la Dirección de Aguas del MINAE argumentaba que solo aplicaba el retiro operacional (ROP) de 40 metros del Decreto 43053-MINAE. La Sala aplicó el principio precautorio y la potestad vinculante del SENARA (artículo 3 inciso h) de la Ley 6877) para adoptar el criterio más protector. Constató que, pese a denuncias desde 2023 y la detección de coliformes fecales, las autoridades no habían tomado medidas eficaces. Declaró el amparo con lugar y ordenó medidas inmediatas, la creación de una instancia interinstitucional en cinco días y un plan de protección en un mes.

El recurrente alega retroceso ambiental. La mayoría declara sin lugar el recurso por no acreditarse eliminación de requisitos ni afectación a derechos. El voto salvado ordena emitir una regulación específica para RPAS en dos meses, al considerar que la dualidad normativa vulnera los principios preventivo, pro natura, de no regresión y de objetivación ambiental. La Sala divide sus criterios: la mayoría no encuentra violación; un magistrado señala que el asunto corresponde a la vía contenciosa; y tres magistrados acogen el amparo y ordenan regulación específica y labores de inspección interinas.

Duty to enforce demolition of illegal works in public streambedDeber de ejecución efectiva de demolición por obras ilegales en cauce

A property owner neighboring Quebrada El Rastro in Atenas filed an amparo against the Municipality of Atenas and MINAE for institutional failure to act against illegal works built by a third party within a public-domain streambed. MINAE's Dirección de Agua had issued a permit for placement of medium rocks, but the permittee instead built a mesh-and-cement wall approximately 15 meters long that throttled the channel and diverted water toward the complainant's property. After an inspection on March 25, 2026, the Dirección de Agua confirmed illegality and ordered demolition within 8 business days but did not enforce its own order. The Constitutional Chamber granted the amparo and ordered MINAE's water directorate to execute the demolition within three months—using substituted administrative execution if necessary—and the Municipality to provide institutional cooperation. The ruling develops the precautionary, prevention, in dubio pro natura, and non-regression principles, and incorporates IACHR OC-32/25 on the climate emergency.Un vecino colindante con la quebrada El Rastro en Atenas interpuso recurso de amparo contra la Municipalidad de Atenas y el MINAE alegando omisión institucional frente a obras ilegales realizadas por un tercero dentro del cauce de dominio público. La Dirección de Agua había otorgado permiso para colocación de rocas medianas, pero el particular construyó un muro de malla y cemento de aproximadamente 15 metros que estrangulaba el cauce y desviaba el flujo hacia la propiedad del recurrente. Tras inspección del 25 de marzo de 2026, la Dirección de Agua confirmó la ilegalidad y ordenó demolición en 8 días hábiles, pero no ejecutó la medida. La Sala Constitucional declaró el amparo con lugar y ordenó que la Dirección de Agua materialice la demolición en 3 meses —incluida la ejecución sustitutiva si el obligado incumple— y que la Municipalidad preste colaboración interinstitucional. La sentencia desarrolla los principios precautorio, preventivo, in dubio pro natura y no regresión ambiental, e incorpora la OC-32/25 de la Corte IDH sobre cambio climático.
