The Constitutional Chamber evacuated the mandatory pre-approval constitutional consultation on Bill No. 25.060 to approve the Agreement on Climate Change, Trade and Sustainability (ACCTS), signed by Costa Rica, Iceland, New Zealand, and Switzerland on November 15, 2024. The Court reviewed the full legislative history—from submission in June 2025 to first-debate approval with 40 votes in March 2026—and found no procedural defects. On the merits, it analyzed all eight chapters of the ACCTS: trade liberalization of environmental goods and services, elimination of harmful fossil fuel subsidies, voluntary eco-labeling, and dispute-resolution mechanisms. It found them compatible with Article 50 of the Constitution and Costa Rica's international greenhouse gas reduction commitments. The Court highlighted that the ACCTS is the first international agreement to discipline fossil fuel subsidies. El Tribunal revisó el iter legislativo —desde la presentación del proyecto en junio de 2025 hasta su aprobación en primer debate con 40 votos en marzo de 2026— y no halló vicios procedimentales. En cuanto al fondo, analizó los ocho capítulos del ACCTS: liberalización del comercio de bienes y servicios ambientales, eliminación de subsidios nocivos a combustibles fósiles, etiquetado ecológico voluntario y mecanismos de solución de controversias. Los encontró compatibles con el artículo 50 constitucional y con los compromisos internacionales de Costa Rica en reducción de gases de efecto invernadero (GEI). Destacó que el ACCTS es el primer acuerdo internacional que disciplina los subsidios a combustibles fósiles. No se detectaron vicios de forma ni de fondo.

By majority vote, it invalidated the second paragraph of Article 33 bis, Article 33 ter, and Transitory Provision II, which governed low-impact, recovery, and rehabilitation works within protection areas. The judgment gave the invalidation declaratory and retroactive effect from the provisions’ effective date while preserving rights acquired in good faith. It upheld the first paragraph of Article 33 bis. The Chamber also interpreted that article’s final paragraph to clarify that the Water Directorate’s power to authorize works neither displaces SETENA’s authority nor eliminates the requirement for a prior environmental impact assessment when technically warranted by the particular work or activity. La sentencia atribuyó efectos declarativos y retroactivos a la anulación desde la entrada en vigor de esas normas, respetando los derechos adquiridos de buena fe. En cambio, mantuvo el primer párrafo del artículo 33 bis. Además, interpretó su último párrafo para precisar que la potestad de la Dirección de Agua de autorizar obras no desplaza las competencias de la SETENA ni elimina la evaluación de impacto ambiental previa cuando resulte técnicamente necesaria según la obra o actividad. Tres magistrados salvaron parcialmente el voto: consideraron constitucionales las disposiciones anuladas si la clasificación de bajo impacto se fundamentaba previamente en un estudio técnico.

The Constitutional Chamber denied the challenge to Executive Decree No. 40075-MICITT-S-MEIC-MINAE-MOPT and SETENA Agreement ACP-30-2017, which reserve environmental impact assessment for telecommunications towers and, under the current technical criterion, exclude poles. It held that the amendment neither eliminated nor weakened SETENA’s authority, but left that technical agency to determine which infrastructure must obtain environmental viability according to its impacts. The Chamber accepted the distinction between towers and poles: although both support equipment, their dimensions, foundations, loads, and environmental effects differ. According to SETENA, pole installation is an activity with very low potential environmental impact and remains subject to municipal and sector-specific controls. Towers do require environmental assessment and may be subject to more specific instruments and stricter requirements when located in environmentally fragile areas. The Chamber found neither environmental regression nor a lack of technical support and characterized the remaining objections as matters of ordinary legality outside constitutional review.La Sala Constitucional rechazó la acción dirigida contra el Decreto Ejecutivo n.º 40075-MICITT-S-MEIC-MINAE-MOPT y el acuerdo ACP-30-2017-SETENA, que reservan la evaluación de impacto ambiental para las torres de telecomunicaciones y excluyen, según el criterio técnico vigente, los postes. Determinó que la reforma no eliminó ni debilitó las competencias de SETENA, sino que dejó a ese órgano técnico decidir cuáles infraestructuras deben tramitar viabilidad ambiental conforme a su impacto. La Sala aceptó la diferenciación entre torres y postes: aunque ambos sostienen equipos, sus dimensiones, cimentaciones, cargas y efectos ambientales son distintos. Según SETENA, instalar postes constituye una actividad de muy bajo impacto ambiental potencial y permanece sujeta a controles municipales y sectoriales. Las torres sí requieren evaluación ambiental y, cuando se ubiquen en áreas ambientalmente frágiles, pueden quedar sometidas a instrumentos y requisitos más rigurosos. La Sala no constató regresión ambiental ni falta de sustento técnico y calificó las restantes objeciones como asuntos de legalidad ordinaria.

The Constitutional Chamber granted the challenge against Executive Decree No. 42404-MINAE, which had excluded approximately 81.9 hectares from the Tivives Protected Zone under the guise of correcting its boundaries. The judgment determined that the measure was a reduction of a protected wildlife area rather than the correction of a mere clerical or factual error. Such a reduction had to comply with the statutory-reservation requirement and be supported by specific technical studies scientifically justifying its environmental effects, pursuant to Article 50 of the Constitution and Article 38 of the Organic Environmental Law. The Chamber annulled the decree and ordered the Attorney General’s Office to take the necessary legal action within twelve months to protect public assets and restore the protected zone to its previous extent. The ruling preserved the possibility of state financial liability. A separate opinion maintained that the decree’s manifest unconstitutionality precluded recognition of any good-faith acquired rights arising while it was in force.La Sala Constitucional declaró con lugar la acción contra el Decreto Ejecutivo No. 42404-MINAE, que había excluido aproximadamente 81,9 hectáreas de la Zona Protectora Tivives bajo la figura de una rectificación de linderos. Esa reducción debía respetar la reserva de ley y contar con estudios técnicos específicos que justificaran científicamente sus efectos ambientales, conforme al artículo 50 constitucional y al artículo 38 de la Ley Orgánica del Ambiente. La Sala anuló el decreto y ordenó a la Procuraduría General de la República ejercer, dentro de doce meses, las acciones necesarias para defender el patrimonio público y restituir la zona protectora a su extensión anterior. La decisión dejó abierta la posible responsabilidad patrimonial del Estado. Un voto particular sostuvo que la manifiesta inconstitucionalidad del decreto impedía reconocer derechos adquiridos de buena fe derivados de su vigencia.

The Constitutional Chamber grants an unconstitutionality action against phrases in Executive Decree 42747-MINAE that conditioned the import, transport, distribution and marketing of liquefied natural gas (LNG) exclusively to the substitution of bunker fuel in industrial and commercial use. The Chamber finds that this restriction violates the principles of reasonableness, proportionality, objectivation of environmental protection (lack of technical studies), non-regression, precaution, prevention and pro natura, by limiting the use of a cleaner transition fuel solely to replace bunker, even though Decree 37413-MINAET of 2012 had declared the import, use and distribution of LNG as a public-interest activity as a transition fuel toward cleaner options in general. Furthermore, for the self-consumption regime, the restriction imposed by executive decree breaches the reserve of law and freedom of enterprise. The Chamber clarifies that LNG regulation under a public-service regime is not unconstitutional, since that activity is reserved to the State and subject to stricter regulation.La Sala Constitucional declara con lugar una acción de inconstitucionalidad contra frases del Decreto Ejecutivo 42747-MINAE que condicionaban la importación, transporte, distribución y comercialización de gas natural licuado (GNL) exclusivamente a la sustitución del búnker en uso industrial y comercial. La Sala considera que dicha restricción vulnera los principios de razonabilidad, proporcionalidad, objetivación de la tutela ambiental (falta de estudios técnicos), no regresividad, precautorio, preventivo y pro natura, al limitar el uso de un combustible de transición más limpio únicamente para reemplazar el búnker, pese a que el Decreto 37413-MINAET de 2012 había declarado de interés público la importación, uso y distribución del GNL como combustible de transición hacia opciones más limpias en general. Además, tratándose del régimen de autoconsumo, la restricción impuesta por decreto ejecutivo vulnera la reserva de ley y la libertad de empresa. La Sala aclara que la regulación del GNL en régimen de servicio público no resulta inconstitucional, dado que esa actividad está reservada al Estado y sujeta a una regulación más intensa.

The Constitutional Chamber denied the constitutional challenge brought by three fishing associations against Executive Decree No. 43368-MINAE, which expanded Cocos Island National Park and created a marine management area. It held that describing the boundaries through UTM Zone 16 coordinates did not create legal uncertainty because affordable equipment capable of reading those coordinates exists. The Chamber also found no violation of legitimate expectations: fishing permit holders know that the sea is public-domain property and that the State may create or expand protected wildlife areas to safeguard the environmental right guaranteed by Article 50 of the Constitution. Moreover, the decree neither revoked licenses, concessions, or permits nor made all fishing activity impossible. The Chamber rejected the remaining claims concerning freedom of enterprise, employment, equality, and other rights because they lacked clear, precise, and concrete supporting arguments. It therefore concluded that the decree did not violate constitutional law on the grounds asserted by the fishing associations.La Sala Constitucional rechazó la acción interpuesta por tres asociaciones pesqueras contra el Decreto Ejecutivo No. 43368-MINAE, que amplió el Parque Nacional Isla del Coco y creó un área marina de manejo. Determinó que el uso de coordenadas bajo la proyección UTM Zona 16 no producía incertidumbre jurídica, pues existen equipos accesibles capaces de interpretarlas. También descartó una lesión a la confianza legítima: quienes reciben permisos de pesca conocen el carácter demanial del mar y la potestad estatal de crear o ampliar áreas silvestres protegidas para tutelar el derecho al ambiente del artículo 50 constitucional. Además, el decreto no eliminó licencias, concesiones o permisos ni imposibilitó toda actividad pesquera. La Sala desestimó los restantes reclamos sobre libertad de empresa, trabajo, igualdad y otros derechos porque carecían de argumentos claros, precisos y concretos. En consecuencia, concluyó que el decreto no contravenía el Derecho de la Constitución en los términos alegados.

The Constitutional Chamber denied the amparo brought on behalf of the Los Robles rural water association concerning alleged threats to the environment, springs, and water supply caused by earthworks, tree removal, and agricultural activities by Agrícola Pascale S.A. within the El Chayote Protected Zone. The Court found that the Municipality of Naranjo, SINAC, and SETENA had addressed the complaints through inspections, work closures and suspensions, interagency coordination, environmental review, and referral of relevant facts to the Public Prosecutor’s Office. It also found no harmful act or omission attributable to SENARA or MINAE. Accordingly, the Court did not establish any openly arbitrary, disproportionate, delayed, or negligent administrative conduct violating fundamental rights. It nevertheless instructed the respondent authorities to coordinate and undertake every action within their jurisdiction so that future activities on the property comply with the preventive and precautionary principles and safeguard the right to a healthy and ecologically balanced environment.La Sala Constitucional declaró sin lugar el amparo promovido a favor de la ASADA Los Robles por presuntas amenazas al ambiente, las nacientes y el abastecimiento de agua derivadas de movimientos de tierra, corta de árboles y actividades agrícolas de Agrícola Pascale S. A. dentro de la Zona Protectora El Chayote. El Tribunal constató que la Municipalidad de Naranjo, el SINAC y la SETENA habían atendido las denuncias mediante inspecciones, clausuras y paralización de obras, coordinación interinstitucional, evaluación ambiental y remisión de hechos al Ministerio Público. Tampoco comprobó una acción u omisión lesiva atribuible al SENARA o al MINAE. Por ello, no estimó demostrada una conducta administrativa abiertamente arbitraria, desproporcionada, tardía o negligente que lesionara derechos fundamentales. No obstante, advirtió a las autoridades que deben coordinar y ejercer todas sus competencias para garantizar que las actividades futuras en la propiedad respeten los principios preventivo y precautorio y el derecho a un ambiente sano y ecológicamente equilibrado.

The Constitutional Chamber denied the challenge to Executive Decree No. 42755-MINAE, which assigns different environmental assessment instruments to mariculture projects according to their scale. The Chamber held that Article 50 of the Constitution requires prior environmental assessment for activities capable of significantly affecting the environment, but does not require the specific instrument known as an environmental impact study (EsIA) in every case. Environmental registration for social-family aquaculture, an affidavit of environmental commitments for small-scale projects, an environmental management forecast-plan for medium-scale projects, and an EsIA for large-scale projects satisfy that obligation when assigned according to potential impact. The classification rests on objective criteria such as concession area, annual production, and cultivated species. Minimum separation distances, production limits, water-use concessions, and institutional authorizations also restrict the activity. Accordingly, the decree neither violates the right to a healthy environment nor exceeds the Executive Branch’s regulatory authority. One justice dissented, considering the differentiated regime unconstitutional.La Sala Constitucional declaró sin lugar la acción contra el Decreto Ejecutivo N.º 42755-MINAE, que establece instrumentos diferenciados de evaluación ambiental para proyectos de maricultura según su escala. Determinó que el artículo 50 constitucional exige una evaluación de impacto ambiental previa para las actividades capaces de afectar significativamente el ambiente, pero no obliga a utilizar en todos los casos el instrumento específico denominado estudio de impacto ambiental (EsIA). El registro ambiental para acuicultura social-familiar, la declaración jurada de compromisos ambientales para pequeña escala, el pronóstico-plan de gestión ambiental para mediana escala y el EsIA para gran escala satisfacen esa obligación cuando se asignan conforme al impacto potencial. La clasificación se apoya en criterios objetivos como el área concesionada, la producción anual y la especie cultivada. También existen distancias mínimas, límites productivos, concesiones de agua y autorizaciones institucionales que restringen la actividad. Por ello, el decreto no vulnera el derecho al ambiente ni excede la potestad reglamentaria.

The Court found that this framework weakened environmental prevention, conflicted with the Hydrocarbons Law, and lacked sufficient technical and scientific justification under Costa Rica’s geological and environmental conditions. It emphasized that the Administration must have a comprehensive understanding of potential impacts before activities capable of affecting the environment begin, and that purely economic considerations cannot justify reduced protection of the right to a healthy and ecologically balanced environment. The judgment gave the annulment erga omnes, declaratory, and retroactive effect from February 27, 1998, while preserving rights acquired in good faith. Consideró que ese esquema debilitaba la prevención ambiental, contrariaba la Ley de Hidrocarburos y carecía de una justificación técnica y científica suficiente para las condiciones geológicas y ambientales de Costa Rica. El Tribunal destacó que la Administración debe conocer integralmente los posibles impactos antes de iniciar actividades capaces de afectar el ambiente y que las consideraciones económicas no justifican reducir la tutela del derecho a un ambiente sano y ecológicamente equilibrado. La nulidad se declaró con efectos erga omnes, declarativos y retroactivos al 27 de febrero de 1998, preservando los derechos adquiridos de buena fe. Además, se restableció, una vez firme la sentencia, la vigencia del artículo 2 y del título X del anterior Reglamento a la Ley de Hidrocarburos.

The Court partially granted the action concerning the El Diquís Hydroelectric Project. It held that there was no basis to order an immediate environmental assessment, limit that assessment exclusively to the Térraba Indigenous Territory, or require a Strategic Environmental Assessment. It also declined to mandate a remediation plan or compensatory measures because environmental damage attributable to ICE or the State had not been proven. Nevertheless, the Court ruled that if ICE resumes geological research at the Térraba site, it must initiate the environmental-review procedure under the rules then in force, obtain the permits required for tree cutting, earthmoving, excavation, and works within river channels, and comply with whichever assessment instrument SETENA selects according to the environmental significance of each activity. The Court further ordered ICE and the State to refrain from research- or investment-stage administrative conduct capable of affecting the reserve’s environment or biodiversity until prior, free, and informed Indigenous consultation has occurred and the applicable environmental-review instrument is in place.El Tribunal declaró parcialmente con lugar la demanda relativa al Proyecto Hidroeléctrico El Diquís. Determinó que no correspondía ordenar inmediatamente una evaluación ambiental, circunscribirla exclusivamente al territorio indígena de Térraba ni imponer una Evaluación Ambiental Estratégica. También rechazó ordenar un plan remedial o medidas compensatorias, porque no se demostraron daños ambientales atribuibles al ICE o al Estado. Sin embargo, dispuso que, si el ICE retoma la investigación geológica en el Sitio Térraba, deberá iniciar el procedimiento de evaluación ambiental conforme a la normativa vigente, obtener los permisos necesarios para corta de árboles, movimientos de tierra, excavaciones y obras en cauces, y someterse al instrumento que SETENA determine según la significancia de cada actividad. Además, ordenó al ICE y al Estado abstenerse de realizar actuaciones de investigación o inversión capaces de afectar el ambiente o la biodiversidad de la reserva mientras no exista consulta indígena previa, libre e informada y la evaluación ambiental correspondiente.

It held that SETENA’s approval of the route change substantially complied with the legal system and constituted valid environmental approval. The decision was supported by technical and socio-environmental considerations, including the need to avoid geologically unstable land and areas of high environmental fragility. According to the evidence, foreseeable impacts on springs, mangroves, biodiversity, and nearby residents had been evaluated and addressed through mitigation and compensation measures. The evidence also failed to establish that electromagnetic fields from the transmission lines caused harm to health or the environment when operating within the applicable regulatory limits. The Court rejected the defense of lack of passive standing, upheld the defense that the claimant lacked a substantive right to relief, temporarily maintained the precautionary measure, and imposed no costs because litigation was reasonably justified by the diffuse environmental and public-health interests involved.El Tribunal declaró sin lugar la demanda que cuestionaba la modificación del trazado del tramo CR-07, subtramo Portalón, del Proyecto SIEPAC. Concluyó que el acuerdo de SETENA que aprobó el cambio de ruta era sustancialmente conforme con el ordenamiento jurídico y constituía una viabilidad ambiental válida. La decisión se apoyó en razones técnicas y socioambientales, incluida la necesidad de evitar terrenos geológicamente inestables y áreas de alta fragilidad ambiental. Según la prueba evacuada, los impactos previsibles sobre nacientes, manglares, biodiversidad y población fueron evaluados y sometidos a medidas de mitigación y compensación. Tampoco se acreditó que los campos electromagnéticos de las líneas de transmisión causaran daños a la salud o al ambiente dentro de los límites reglamentarios vigentes. El Tribunal rechazó la falta de legitimación pasiva, acogió la excepción de falta de derecho, mantuvo temporalmente la medida cautelar y dispensó las costas porque existía motivo suficiente para litigar en defensa de intereses difusos ambientales y sanitarios.

The Administrative Litigation Court declared Executive Decree 26750-MINAE absolutely null because it allowed the environmental impact studies required for petroleum exploration and exploitation contracts to be divided into phases. The Court held that the Executive exceeded its regulatory authority: the Hydrocarbons Law and the Organic Environmental Law required a complete, prior environmental assessment consistent with environmental protection and the precautionary principle. A regulation could not make approval of an assessment for an initial prospecting phase sufficient to finalize the concession award, because the governing statutes did not authorize that division. The nullity was given declaratory effect retroactive to February 27, 1998, while preserving rights acquired in good faith. Once the judgment became final, article two and articles 266 through 283 of Title X of the Regulations to the Hydrocarbons Law would regain their original force. The Court rejected the State’s defenses concerning lack of current interest and lack of legal entitlement and ordered the State to pay both procedural and attorney costs.El Tribunal Contencioso Administrativo declaró la nulidad absoluta del Decreto Ejecutivo 26750-MINAE, que permitía dividir por fases los estudios de impacto ambiental requeridos para los contratos de exploración y explotación de hidrocarburos. Determinó que el Poder Ejecutivo excedió su potestad reglamentaria porque las leyes de Hidrocarburos y Orgánica del Ambiente exigían una evaluación ambiental completa y previa, conforme a la finalidad protectora del ambiente y al principio precautorio. El reglamento no podía autorizar que la aprobación del estudio correspondiente a una primera fase de prospección bastara para dejar firme la adjudicación, pues esa división no estaba contemplada en las normas superiores. La nulidad produce efectos declarativos y retroactivos al 27 de febrero de 1998, sin afectar derechos adquiridos de buena fe. Una vez firme la sentencia, recobran vigencia el artículo segundo y los artículos 266 a 283 del Título X del Reglamento a la Ley de Hidrocarburos. El Estado fue condenado al pago de ambas costas.

That approval also did not grant environmental viability for field research activities. Accordingly, the State’s refusal to execute the contract rested on technical and legal grounds and complied with the principle of legality rather than reflecting political considerations. El documento aprobado mediante la resolución 866-2000-SETENA únicamente comprendía la recopilación y el análisis de información bibliográfica, sin labores de campo ni interacción con el ambiente; por ello, su denominación administrativa como estudio de impacto ambiental no podía modificar su verdadera naturaleza. Esa aprobación tampoco otorgó viabilidad ambiental para las actividades de investigación de campo. En consecuencia, la negativa estatal a suscribir el contrato respondió a razones técnico-jurídicas y al principio de legalidad, no a motivos políticos. Se acogió la excepción de falta de derecho, se declaró sin lugar la demanda y se impusieron ambas costas a la actora.

En primera instancia, el acusado fue condenado por el delito de infracción a la Ley de Vida Silvestre y se le impuso una pena de prisión de un año, así como la obligación de pagar indemnización por daño ambiental de tres mil dólares. La defensa apeló alegando falta de fundamentación en la fijación de la consecuencia civil, argumentando desproporcionalidad frente a la situación económica del imputado y la omisión de motivación sobre el monto fijado. El Tribunal de Apelación, tras revisar la sentencia oral, constata que, si bien el juzgador de primera instancia desarrolló los presupuestos de la responsabilidad civil ambiental (hecho generador, nexo causal y daño), no expuso ninguna razón que justificara la cuantificación del daño en tres mil dólares. Esta omisión vulnera el deber de fundamentación de las resoluciones judiciales. Por ello, declara con lugar el recurso y ordena el reenvío de la causa para que, con diferente integración, se realice una nueva fijación del monto indemnizatorio de manera motivada, manteniendo incólume el resto del fallo. La jueza Montero Mena agrega una nota separada sobre la preferencia del colón como moneda de curso legal.

It orders cancellation of the concession, mandates a remedial and recovery plan for the river and surrounding areas under State supervision, and keeps in force the earlier precautionary measure ordering routine inspections. Both defendants are ordered to pay costs.La sentencia declara con lugar la demanda de un abogado particular contra Los Manantiales del Pacífico N Y S S.A. y el Estado, por incumplimientos de las condiciones de la concesión de explotación de materiales en el cauce del Río Naranjo, otorgada mediante resolución R-097-2018-MINAE. El Tribunal verificó múltiples irregularidades: invasión de zonas de protección de quebradas y del río, perforación de pozo ilegal, extracción no laminar a mayor profundidad de la autorizada, afectación a diques, incumplimientos en el manejo de materiales, emisión de polvo, falta de construcción de lagunas de sedimentación y apertura de caminos ilegales. Considera probada la responsabilidad ambiental de la concesionaria y la omisión estatal en su fiscalización. Ordena cancelar la concesión, elaborar y aplicar un plan remedial en el río y áreas aledañas, y mantener vigente la medida cautelar de inspecciones periódicas dictada en apelación. Condena a ambas partes demandadas al pago de costas.

El tribunal rechazó los alegatos de la Procuraduría, considerando que la existencia de viviendas, un huerto de frutales y cultivos menores no implicaba lesión a los recursos naturales, pues la cobertura forestal aumentó entre 1974 y 1992 y no hubo tala ni intervención en la quebrada colindante. Concluyó que la posesión ejercida respetó los fines de la zona protectora y que el uso conforme del suelo, avalado por estudio técnico, no contradice la posesión ecológica exigida por el artículo 7 de la Ley de Informaciones Posesorias. La decisión integra criterios del desarrollo sostenible y la compatibilidad de actividades humanas de bajo impacto con las categorías de manejo de áreas silvestres protegidas, citando jurisprudencia constitucional que reconoce el derecho a aprovechar la propiedad conforme al plan de manejo.
