Wildlife Conservation LawLey de Conservación de la Vida Silvestre

This law establishes the regulatory framework for the conservation, management, and sustainable use of wildlife in Costa Rica. It defines the concept of wildlife, declares wild fauna as public domain and wild flora of public interest. It regulates activities such as hunting, collection, extraction, possession, trade, import, and export of wild species, setting up a system of permits, licenses, and management plans under the authority of the National System of Conservation Areas (Sinac). It creates the Wildlife Fund, the National Wildlife Registry, and classifies ex situ management sites. The law typifies crimes and contraventions, including prison sentences and fines for illegal hunting, trade without permits, introduction of invasive exotic species, water body pollution, and wetland destruction. It also incorporates provisions for CITES implementation, regulates inland fishing, and establishes wildlife refuges. It recognizes exceptions for traditional indigenous practices without profit.Esta ley establece el marco normativo para la conservación, manejo y uso sostenible de la vida silvestre en Costa Rica. Define el concepto de vida silvestre, declara de dominio público la fauna silvestre y de interés público la flora silvestre. Tipifica delitos y contravenciones, incluyendo sanciones de prisión y multa para conductas como la caza ilegal, el comercio sin permiso, la introducción de especies exóticas invasoras, la contaminación de cuerpos de agua y la destrucción de humedales. Asimismo, incorpora disposiciones para la implementación de la Convención CITES, regula la pesca continental y establece refugios de vida silvestre. Regulation to Wildlife Conservation Law No. 7317Reglamento a la Ley de Conservación de la Vida Silvestre N° 7317

Executive Decree No. 40548-MINAE establishes the detailed regulation to implement the Wildlife Conservation Law No. 7317, significantly reformed by Law 9106 of 2012 driven by popular initiative. The regulation defines procedures and requirements for the conservation, management, and sustainable use of continental and insular wildlife, both in situ and ex situ, throughout the national territory. It regulates aspects such as the administrative organization (SINAC, CONAVIS), application procedures, permits, conservation and management of wild fauna and flora, management sites (rescue centers, zoos, breeding farms, aquariums, botanical gardens, nurseries), control and subsistence hunting, reintroduction, euthanasia, transport, and the implementation of the CITES Convention. The regulation incorporates principles such as in dubio pro natura, precautionary, and intergenerational equity, and prohibits practices such as falconry, wildlife rental, and the importation of species as pets.Este Decreto Ejecutivo N° 40548-MINAE establece el reglamento detallado para implementar la Ley de Conservación de la Vida Silvestre N° 7317, reformada significativamente por la Ley 9106 del 2012 impulsada por iniciativa popular. El reglamento define los procedimientos y requisitos para la conservación, manejo y uso sostenible de la vida silvestre continental e insular, tanto in situ como ex situ, en todo el territorio nacional. Regula aspectos como la organización administrativa (SINAC, CONAVIS), trámite de solicitudes, permisos, conservación y manejo de fauna y flora silvestre, sitios de manejo (centros de rescate, zoológicos, zoocriaderos, acuarios, jardines botánicos, viveros), cacería de control y de subsistencia, reintroducción, eutanasia, transporte, y la implementación de la Convención CITES. El reglamento incorpora principios como el in dubio pro natura, precautorio y de equidad intergeneracional, y prohíbe prácticas como la cetrería, el alquiler de fauna y la importación de especies como mascotas.

Law for the Protection, Conservation, and Recovery of Sea Turtle PopulationsLey de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas

This law declares scientific research on sea turtles a matter of public interest, mandates Turtle Excluder Devices (TEDs) in shrimp trawl fisheries, and promotes ecotourism in nesting beaches. It establishes criminal penalties of one to three years in prison for killing, capturing, or trading sea turtles, and three months to two years for commercial possession or trade of products. The Ministry of Environment and Energy (MINAE) coordinates protection with other institutions, and training programs are created for local guides in ecotourism beaches. Egg collection of olive ridley turtles in Ostional is allowed if it follows MINAE regulations.Esta ley declara de interés público la investigación científica sobre tortugas marinas, obliga al uso de Dispositivos Excluidores de Tortugas (DET) en la pesca de arrastre camaronera, y promueve el ecoturismo en playas de anidamiento. Establece sanciones penales de uno a tres años de prisión por matar, capturar o comercializar tortugas marinas, y de tres meses a dos años por retención comercial o comercio de productos. El MINAE coordina con otras instituciones la protección, y se crean programas de capacitación para guías locales en playas declaradas de interés ecoturístico. La recolección de huevos de tortuga lora en Ostional es permitida si se ajusta a la reglamentación del MINAE.

Ley 8325 is the specialty statute for sea turtle products; courts treat it as concurrent with Art. 95 and apply Art. 95 when commercial purpose is not pleaded.La Ley 8325 es la norma especial sobre productos de tortuga marina; los tribunales la tratan como concurrente con el Art. 95 y aplican este último cuando no se acredita ánimo de lucro.

Special Law Governing Transport of Sea Turtle EggsLey especial aplicable al trasiego de huevos de tortuga marinaDeniedSin lugar

The Third Chamber denied the Public Prosecutor’s cassation appeal and upheld the reclassification of the conduct attributed to the defendant, who was caught transporting leatherback sea turtle eggs for commercial purposes. Although the conduct appeared to fall under both Article 95 of the Wildlife Conservation Law, which generally protects wild animals and their derivatives, and Article 6 of Law No. 8325, the Chamber found an apparent concurrence of criminal provisions. Applying Article 23 of the Criminal Code and the principle of specialty, it concluded that the Law for the Protection, Conservation and Recovery of Sea Turtle Populations prevails because it contains the elements of the general offense while adding the special element of a sea turtle. The ruling unified the case law: matters fully encompassed by the special legislation must be prosecuted under Law No. 8325. This does not implicitly repeal the general wildlife legislation, which continues to apply to matters not covered by the special sea turtle law.La Sala Tercera rechazó el recurso de casación del Ministerio Público y confirmó la recalificación de la conducta atribuida al imputado, quien fue sorprendido trasladando huevos de tortuga baula con fines comerciales. Aunque el hecho podía parecer comprendido tanto en el artículo 95 de la Ley de Conservación de la Vida Silvestre, que protege genéricamente a los animales silvestres y sus derivados, como en el artículo 6 de la Ley N.º 8325, la Sala determinó que existe un concurso aparente de normas. Aplicando el artículo 23 del Código Penal y el principio de especialidad, concluyó que la Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas prevalece porque contiene los elementos del tipo general y añade el elemento especializante de la tortuga marina. La decisión unificó la jurisprudencia: en asuntos comprendidos íntegramente por la normativa especial debe aplicarse la Ley N.º 8325, sin que ello derogue tácitamente la legislación general sobre vida silvestre, aplicable a lo no regulado por aquella.

Transporting Turtle Eggs and the Duty to Justify SentencingTrasiego de huevos de tortuga y fundamentación de la penaPartially grantedParcialmente con lugar

The Criminal Judgment Appeals Court upheld the conclusion that moving leatherback turtle eggs without authorization constitutes “trasegar” under Article 95 of the Wildlife Conservation Law. Turtle eggs are animal derivatives rather than aquatic-fauna products, so the court rejected application of Article 150(a) of the Fisheries and Aquaculture Law. It nevertheless granted the second appellate claim because the trial judgment imposed imprisonment without explaining why it rejected the less severe alternative fine expressly available under the offense. The civil award for environmental harm was also inadequately reasoned: formal compliance by the civil claimant and the causal explanation advanced by the Attorney General’s Office could not replace the court’s own analysis of causation, entitlement to relief, and the defense objections. The appellate court therefore partially vacated the judgment as to the sentence and civil liability and remanded those matters for renewed adjudication according to law, while leaving intact the determination that the defendants’ unauthorized transport of the eggs satisfied the wildlife offense.El Tribunal de Apelación confirmó que trasladar sin permiso huevos de tortuga baula configura el verbo típico «trasegar» del artículo 95 de la Ley de Conservación de la Vida Silvestre. Los huevos son derivados del animal, no productos de fauna acuática, por lo que descartó aplicar el artículo 150 inciso a) de la Ley de Pesca y Acuicultura. Sin embargo, acogió el segundo motivo de apelación porque la sentencia impuso prisión sin explicar por qué desechaba la multa, alternativa menos severa prevista por el mismo tipo penal. También consideró insuficientemente fundamentada la condena civil por daño ambiental: el cumplimiento formal de la acción civil y la explicación ofrecida por la Procuraduría no sustituían el análisis judicial de la relación causal, la procedencia de las pretensiones ni las excepciones de la defensa. En consecuencia, anuló parcialmente la sentencia respecto de la pena y la condena civil y ordenó un nuevo examen de ambos puntos, manteniendo la determinación de responsabilidad penal.

The Criminal Appeals Court of the Second Judicial Circuit of San José reviewed an appeal against a conviction by the Flagrancy Court of Limón. The defendant was convicted of violating the Wildlife Conservation Law, sentenced to one year in prison, and ordered to pay three thousand dollars in environmental damages. The defense appealed, claiming the civil damages award lacked reasoning and was disproportionate to the defendant's financial situation. The Appeals Court found that while the trial judge established the elements of environmental civil liability—harmful act, causation, and damage—no justification was provided for quantifying the damage at three thousand dollars. This omission breaches the duty to state reasons for judicial decisions. Accordingly, the appeal was granted, and the case was remanded for a new hearing solely to determine the compensation amount with proper reasoning, with the rest of the ruling untouched. Judge Montero Mena submitted a separate note on the preference for using colones as legal tender.El Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José conoce del recurso de apelación contra una sentencia condenatoria del Tribunal Penal de Flagrancia de Limón. En primera instancia, el acusado fue condenado por el delito de infracción a la Ley de Vida Silvestre y se le impuso una pena de prisión de un año, así como la obligación de pagar indemnización por daño ambiental de tres mil dólares. La defensa apeló alegando falta de fundamentación en la fijación de la consecuencia civil, argumentando desproporcionalidad frente a la situación económica del imputado y la omisión de motivación sobre el monto fijado. El Tribunal de Apelación, tras revisar la sentencia oral, constata que, si bien el juzgador de primera instancia desarrolló los presupuestos de la responsabilidad civil ambiental (hecho generador, nexo causal y daño), no expuso ninguna razón que justificara la cuantificación del daño en tres mil dólares. Esta omisión vulnera el deber de fundamentación de las resoluciones judiciales. Por ello, declara con lugar el recurso y ordena el reenvío de la causa para que, con diferente integración, se realice una nueva fijación del monto indemnizatorio de manera motivada, manteniendo incólume el resto del fallo. La jueza Montero Mena agrega una nota separada sobre la preferencia del colón como moneda de curso legal.

Trafficking of leatherback turtle eggs: specialty principle between Law 7317 and Law 8325Trasiego de huevos de tortuga baula: principio de especialidad entre Ley 7317 y Ley 8325DeniedSin lugar

The Criminal Appeals Tribunal confirmed the conviction of two individuals for trafficking 448 leatherback turtle eggs, an endangered species. The defense argued that the conduct was atypical because Law 8325 (Law for the Protection, Conservation and Recovery of Sea Turtle Populations) does not penalize the trafficking of eggs, and that the principle of specialty should apply. However, the Tribunal determined that Law 8325 does not repeal or exclude the application of Law 7317 (Wildlife Conservation Law), whose Article 95 penalizes the trafficking of products or derivatives from endangered species, such as the leatherback turtle. The Tribunal also pointed out that the exception for olive ridley egg collection in Ostional does not apply to this case. The Tribunal concluded that the principle of specialty had not been violated and denied the appeal.El Tribunal de Apelación de Sentencia Penal confirmó la condena de dos personas por el delito de tráfico de 448 huevos de tortuga baula, una especie en peligro de extinción. La defensa alegó que la conducta era atípica porque la Ley 8325 (Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas) no sanciona el trasiego de huevos, y que debía aplicarse el principio de especialidad. Sin embargo, el Tribunal determinó que la Ley 8325 no deroga ni excluye la aplicación de la Ley 7317 (Ley de Conservación de la Vida Silvestre), cuyo artículo 95 sanciona el trasiego de productos o derivados de especies en peligro de extinción, como la tortuga baula. Además, señaló que la excepción de recolección de huevos de tortuga lora en Ostional no se aplica al caso. El Tribunal concluyó que no se vulneró el principio de especialidad y rechazó el recurso.

Reclassification of sea turtle egg transport: Wildlife Law prevails over Fisheries LawRecalificación de transporte de huevos de tortuga: Ley de Vida Silvestre prevalece sobre Ley de PescaGrantedCon lugar

The Guanacaste Criminal Appeals Court partially overturns a trial conviction for transporting 72 olive ridley sea turtle eggs at Ostional Beach, originally sentenced under Article 150 of the Fisheries and Aquaculture Law. The Court applies the apparent-concurrence-of-norms doctrine under Criminal Code Article 23, finding that the Wildlife Conservation Law (Law 7317), amended in 2008, is the posterior and more specific statute for the unauthorized transport of wildlife products. The facts are reclassified to Article 95(b) of Law 7317, which penalizes trafficking in non-endangered species' products with a fine or imprisonment. The case is remanded solely for resentencing.El Tribunal de Apelación de Sentencia Penal de Guanacaste anula parcialmente la sentencia de flagrancia que condenó a un imputado por transportar 72 huevos de tortuga Lora en Playa Ostional, basada en el artículo 150 de la Ley de Pesca y Acuicultura. La Cámara determina que existe un concurso aparente de normas entre dicha ley y la Ley de Conservación de la Vida Silvestre (Ley 7317), aplicando los principios de especialidad, subsidiariedad y consunción del artículo 23 del Código Penal. Dado que la conducta consistió en comercio/transporte de productos de vida silvestre sin permiso, y que la Ley de Vida Silvestre fue reformada en 2008 (posterior a la Ley de Pesca de 2005), se recalifican los hechos al artículo 95 inciso b) de la Ley 7317, que sanciona con multa o prisión el tráfico de animales o sus productos cuando no están en peligro de extinción. Se ordena el reenvío para fijar la nueva pena, dejando incólume el resto de la sentencia.

Noncommercial Transport of Sea Turtle EggsTrasiego no comercial de huevos de tortuga marinaDeniedSin lugar

The Third Chamber denied the cassation appeal challenging the reclassification of the unauthorized collection and transport of 104 leatherback sea turtle eggs as trafficking in wildlife products. It held that Law No. 8325, although specifically protecting sea turtles and penalizing commercially motivated conduct, did not expressly or implicitly repeal Article 95 of the Wildlife Conservation Law. The specialty principle displaces the general rule only when the conduct is fully encompassed by the special offense; otherwise, the applicable general legislation remains enforceable. Consequently, the absence of a profit motive does not decriminalize the transport of eggs belonging to an endangered species. The Chamber found that such conduct causes significant environmental harm regardless of whether it serves a commercial purpose. It further reasoned that criminal statutes must be interpreted harmoniously with the constitutional right to a healthy and ecologically balanced environment, Costa Rica’s international obligations, and the progressive legal protection afforded to sea turtle populations.La Sala Tercera rechazó el recurso de casación contra la recalificación como trasiego de productos de animales silvestres de la recolección y transporte, sin permiso del SINAC, de 104 huevos de tortuga baula. Determinó que la Ley N.º 8325, aunque protege específicamente a las tortugas marinas y sanciona conductas con fines comerciales, no derogó expresa ni tácitamente el artículo 95 de la Ley de Conservación de la Vida Silvestre. El principio de especialidad solo desplaza la norma general cuando la conducta está íntegramente comprendida en el tipo especial; de lo contrario, continúa aplicándose la legislación general vigente. Por ello, la ausencia de finalidad lucrativa no despenaliza el trasiego de huevos de una especie en peligro de extinción. La Sala consideró que esa conducta causa un daño ambiental importante independientemente de su propósito comercial y que la interpretación penal debe armonizarse con el derecho constitucional a un ambiente sano, los instrumentos internacionales y la protección progresiva de las tortugas marinas.

Nullification of acquittal for hunting in national parkAnulación de sentencia absolutoria por caza en parque nacionalGrantedCon lugar

The Criminal Appeals Court of Guanacaste annulled the trial court's ruling that had acquitted the defendant of hunting and convicted him only of illegal wildlife trafficking. The prosecution's appeal argued insufficient reasoning, claiming the trial judge failed to holistically assess the evidence linking the accused to the killing of a Crax rubra bird within a national park. The appellate court found flaws in the judgment's reasoning: the lower court merely repeated witness statements without analyzing elements such as the defendant's nighttime presence in a protected area, the clothing and equipment seized, and the nature of the animal's death. It also pointed out the contradiction of stating there was no evidence while describing the seizure of the dead bird and a machete. The nullification also affected the trafficking conviction, given a possible apparent concurrence with the hunting offense, as well as the civil damages award. A retrial was ordered, with the maximum penalty capped at one year.El Tribunal de Apelación de Sentencia Penal de Guanacaste anuló la sentencia del Tribunal de Juicio que había absuelto al imputado por el delito de caza y lo condenó únicamente por trasiego ilegal de vida silvestre. La apelación del Ministerio Público alegó falta de fundamentación, argumentando que la jueza no valoró integralmente las pruebas que vinculaban al acusado con la caza de un ave de la especie Crax rubra dentro de un parque nacional. El tribunal de apelación encontró vicios en la motivación: la sentencia se limitó a repetir testimonios sin analizar elementos como la presencia nocturna del imputado en área protegida, la ropa y equipo incautados, y la naturaleza de la muerte del animal. Además, señaló la contradicción de afirmar falta de prueba mientras se describía el decomiso del ave muerta y un machete. La nulidad alcanzó también la condena por trasiego, por existir un posible concurso aparente con el delito de caza, y la acción civil resarcitoria. Se ordenó un juicio de reenvío, fijando el tope máximo de pena en un año.

Turtle nest destruction consumed by wildlife product trafficking — unity of action and apparent concurrenceDestrucción de nidos de tortuga consumida por trasiego — unidad de acción y concurso aparenteGrantedCon lugar

The Criminal Sentencing Appeals Court partially overturned a conviction for destruction of nests and trafficking of green turtle eggs in Tortuguero National Park. The trial court had treated digging up nests and collecting eggs as two separate crimes in ideal concurrence, imposing a sentence for both. The defense appealed, arguing it was a single act with one purpose: to take the eggs for trafficking. The appeals court granted the appeal and applied the doctrine of penal unity of action, finding that destroying the nests was the necessary means to commit the trafficking. Because the two actions stood in a means-to-end relationship, affected the same legal interest —wildlife— and carried similar penalties, an apparent concurrence of norms by consumption applied under Article 23 of the Penal Code. Consequently, the court reclassified the proven facts as a single crime of trafficking wildlife products under Article 95 of the Wildlife Conservation Law, ordering remand for resentencing without affecting the rest of the judgment.El Tribunal de Apelación de Sentencia Penal anuló parcialmente una condena por destrucción de nidos y trasiego de huevos de tortuga verde en el Parque Nacional Tortuguero. El tribunal de primera instancia había considerado que excavar los nidos y recoger los huevos constituían dos delitos independientes en concurso ideal, imponiendo pena por ambos. La defensa apeló alegando que se trataba de una sola acción con un único propósito: apoderarse de los huevos para traficarlos. El tribunal de apelación acogió el recurso y aplicó la doctrina de la unidad de acción penal, determinando que la destrucción de los nidos fue el medio necesario para cometer el trasiego. Al existir una relación de medio a fin entre ambas conductas, que afectan el mismo bien jurídico —la vida silvestre— y tienen penas similares, operaba un concurso aparente de normas por consunción, conforme al artículo 23 del Código Penal. En consecuencia, recalificó los hechos como un único delito de trasiego de productos de especies silvestres del artículo 95 de la Ley de Conservación de la Vida Silvestre, ordenando el reenvío para nueva determinación de la pena, sin perjuicio del resto del fallo.
