The Forestry Law (No. 7575) establishes the legal framework for the conservation, protection and management of natural forests and the promotion of forest resources in Costa Rica. It defines key concepts such as forest, forest plantation, forest ecosystem and environmental services. It declares the State's essential function to ensure the adequate and sustainable use of forest resources, prohibiting land-use change in forest-covered land (Art. 19) and requiring management plans for their exploitation. It creates the Forest Fund and the National Forest Financing Fund to finance conservation, reforestation and payment for environmental services programs. It imposes a 3% tax on timber and defines incentives such as the Forest Conservation Certificate (CCB). In addition, it criminalizes offenses against forest resources, including invasion of protected areas, illegal logging, forest fires and land-use change, with prison sentences and seizure of products. The law is of public order and repeals previous legislation, consolidating the Costa Rican forest regime.La Ley Forestal (N° 7575) establece el marco jurídico para la conservación, protección y administración de los bosques naturales y el fomento de los recursos forestales en Costa Rica. Define conceptos clave como bosque, plantación forestal, ecosistema boscoso y servicios ambientales. Declara la función esencial del Estado de velar por el uso adecuado y sostenible de los recursos forestales, prohibiendo el cambio de uso del suelo en terrenos cubiertos de bosque (Art. 19) y exigiendo planes de manejo para su aprovechamiento. Crea el Fondo Forestal y el Fondo Nacional de Financiamiento Forestal para financiar programas de conservación, reforestación y pago de servicios ambientales. Establece un impuesto del 3% sobre la madera y define incentivos como el Certificado para la Conservación del Bosque (CCB). Además, tipifica delitos contra los recursos forestales, incluyendo invasión de áreas protegidas, tala ilegal, incendios forestales y cambio de uso del suelo, con penas de prisión y decomiso de productos. La ley es de orden público y deroga legislación anterior, consolidando el régimen forestal costarricense.

It regulates forestry regencies, voluntary forest certification, transport of forest products, and protection against fires and pests. It establishes the framework for financial incentives such as the Forest Conservation Certificate and Payment for Environmental Services, including contracts, requirements, and grounds for breach. It incorporates recent amendments creating a differentiated payment approach for ecosystem services for forest protection, recognizing premiums for biodiversity and water resources, and establishes funds for sustainable development.Este decreto ejecutivo desarrolla la Ley Forestal N° 7575, estableciendo las definiciones operativas, la organización y competencias de la Administración Forestal del Estado, y los procedimientos detallados para el manejo y aprovechamiento de bosques. The Third Chamber granted the Public Prosecutor’s first two cassation grounds in a case involving the alleged illegal harvesting of a fallen Guanacaste tree. It held that the appellate court had wrongly affirmed the acquittal without conducting the full review required by Article 459 of the Criminal Procedure Code. In particular, the court failed to examine audiovisual records from the initial hearing and trial, although they were essential to determine whether the accusation described the fallen tree, the harvesting of its timber, and the defendants’ joint actions without authorization from the State Forestry Administration. Those records showed that the oral accusation did include these circumstances and had been admitted as clear, precise, and detailed. The Chamber therefore vacated both the appellate decision and the flagrancy-court judgment and ordered a new trial based on the accusation preserved in the audiovisual record. It did not address the third cassation ground because the remand had eliminated any remaining procedural interest in deciding it.La Sala Tercera declaró con lugar los dos primeros motivos del recurso de casación del Ministerio Público en una causa por aprovechamiento ilegal de un árbol de Guanacaste. Determinó que el Tribunal de Apelación confirmó erróneamente la absolutoria sin efectuar el examen integral exigido por el artículo 459 del Código Procesal Penal. En particular, omitió revisar los registros audiovisuales de la audiencia inicial y del debate, pese a que eran esenciales para resolver si la acusación describía el árbol caído, el aprovechamiento de su madera y la actuación conjunta de los imputados sin permiso de la Administración Forestal del Estado. Los registros mostraban que la acusación oral sí contenía esas circunstancias y que había sido admitida como clara, precisa y circunstanciada. La Sala anuló tanto la resolución de apelación como la sentencia de flagrancia y ordenó celebrar un nuevo juicio conforme a la acusación registrada audiovisualmente. No examinó el tercer motivo por carecer de interés procesal después del reenvío.

Environmental Civil Liability Requires Proof of Participation and CausationResponsabilidad civil ambiental exige prueba de participación y causalidadDeniedSin lugar

The Criminal Cassation Chamber denied the Attorney General’s appeal against the civil acquittal of the owner of property where sixteen trees not covered by a forestry permit were unlawfully cut. Although the criminal acquittal did not itself preclude an award of civil damages, no evidence linked the defendant to the cutting or use of the timber, and no causal connection between her conduct and the environmental harm was established. Interpreting Articles 98 and 101 of the Organic Environmental Law, the Chamber held that these provisions permit liability for acts or omissions and impose joint and several liability among responsible parties, but do not replace proof of participation and causation. It also rejected the contention that those provisions impose strict civil liability merely because a person owns the property or holds the permit. The Attorney General improperly alleged an indirect violation of substantive law without effectively challenging the evidentiary reasoning by demonstrating a structural defect.La Sala de Casación Penal rechazó el recurso de la Procuraduría General de la República contra la absolución civil de la propietaria de una finca donde se cortaron ilegalmente dieciséis árboles no cubiertos por el permiso forestal. Aunque la absolución penal no impedía por sí sola una condena resarcitoria, no se aportó prueba que vinculara a la demandada con la corta o el aprovechamiento de la madera ni se acreditó una relación causal entre su conducta y el daño ambiental. La Sala interpretó los artículos 98 y 101 de la Ley Orgánica del Ambiente y concluyó que permiten atribuir responsabilidad por acciones u omisiones y establecen solidaridad entre responsables, pero no sustituyen la prueba de participación y causalidad. También descartó que esas disposiciones establezcan responsabilidad civil objetiva por la mera titularidad del inmueble o del permiso. La Procuraduría planteó indebidamente una violación indirecta de la ley sustantiva, sin impugnar eficazmente el razonamiento probatorio mediante la demostración de un defecto estructural.

Forest Charge Without Temporal Specificity Violates the Right to DefenseAcusación forestal sin determinación temporal vulnera la defensaGrantedCon lugar

The Third Chamber granted an appeal in cassation against a conviction for violating the Forestry Law because the charging instrument failed to specify when the alleged illegal logging occurred. Although it stated the dates on which a forestry report was filed and a MINAE inspection took place, it supplied no date or time range for the cutting of the trees. The Chamber clarified that the certificate of origin governed by Article 31 of the Forestry Law documents the source of timber already cut and authorizes its transport; its application date therefore cannot establish when the logging occurred. The Court of Appeal could not cure the omission through photographs, testimony, or inferences based on the trees’ freshness, because doing so supplied an essential component of the charge and compromised judicial impartiality. Because this absolute defect impaired the defense and could not properly be remedied through a retrial, the Chamber acquitted both defendants of criminal responsibility while leaving the civil disposition undisturbed.La Sala Tercera acogió el recurso de casación contra una condena por infracción a la Ley Forestal, porque la acusación no precisó cuándo ocurrió la tala ilegal atribuida a los imputados. Aunque indicaba las fechas de presentación de un informe forestal y de una inspección del MINAE, no establecía un momento o rango temporal para la corta de los árboles. La Sala aclaró que el certificado de origen regulado por el artículo 31 de la Ley Forestal acredita la procedencia de madera ya talada y autoriza su transporte, por lo que su solicitud no permite inferir cuándo se realizó la tala. El Tribunal de Apelación no podía subsanar esa omisión mediante fotografías, testimonios o deducciones sobre la frescura de los árboles, pues habría completado un elemento esencial de la acusación y comprometido su imparcialidad. Al tratarse de un defecto absoluto que produjo indefensión y no podía corregirse mediante reenvío, la Sala absolvió penalmente a ambos imputados y mantuvo intacto lo resuelto en materia civil.

The appellate court found that the trial judge committed procedural error by failing to properly evaluate decisive evidence, drawing erroneous logical conclusions from the proof, and producing a contradictory judgment. A key eyewitness, an indigenous Cabécar worker, provided direct testimony identifying the defendants and detailing the tree felling, the widening of a logging road using a tractor, and the use of river material for the path. A MINAE geologist clarified that 70 cubic meters of material were extracted, not 70 cubic centimeters, and established environmental harm. Además, se anuló la declaratoria sin lugar de la acción civil resarcitoria, ordenándose el reenvío para nueva sustanciación con diferente integración.

Insufficient Circumstantial Evidence for Illegal Logging ConvictionIndicios insuficientes para condenar por tala ilegalDeniedSin lugar

The Criminal Judgment Appeals Court affirmed the defendant’s acquittal for illegal tree felling and timber harvesting, as well as the dismissal of the State’s civil damages claim. It held that his proximity to a warm chainsaw, sawdust on his clothing, and presence seated on recently cut wood could raise suspicion, but did not amount to serious, precise, and unequivocal circumstantial evidence establishing his active and intentional participation to the degree of certainty required in criminal proceedings. No other evidence disproved the defendant’s explanation for being at the site. The Court also rejected treating his late testimony, earlier silence, or subsequently breached conciliation agreement as evidence of guilt. Such reasoning would reverse the burden of proof and violate the presumption of innocence and the right to a defense. Because authorship remained uncertain, the trial court properly applied in dubio pro reo. The prosecution’s and State Attorney’s appeals were therefore denied in their entirety.El Tribunal de Apelación confirmó la absolución del acusado por tala y aprovechamiento ilegal de madera, así como el rechazo de la acción civil resarcitoria promovida por el Estado. Determinó que su cercanía a una motosierra tibia, el aserrín en sus prendas y el hecho de estar sentado sobre madera recién cortada podían suscitar sospechas, pero no constituían indicios graves, precisos y unívocos capaces de demostrar, con la certeza exigida en materia penal, su participación activa y dolosa. La explicación del acusado sobre su presencia en el lugar no fue desvirtuada por otra prueba. El Tribunal también rechazó que su declaración tardía, su silencio previo o la conciliación posteriormente incumplida pudieran emplearse como señales de culpabilidad. Hacerlo invertiría la carga de la prueba y vulneraría la presunción de inocencia y el derecho de defensa. Ante la duda sobre la autoría, consideró correctamente aplicado el principio in dubio pro reo y declaró sin lugar ambas apelaciones.

It held that, even in a special abbreviated proceeding, the parties may negotiate punishment only within the terms authorized by Article 374 of the Code of Criminal Procedure; their lack of opposition to an alternative sentence does not bind the sentencing court to grant it. Under Article 56 bis of the Criminal Code, substitution is a judicial discretion requiring an assessment of its appropriateness and proportionality, as well as compliance with the statutory conditions. The defendant’s earlier failure to complete a reparative plan under a suspended prosecution—which included community work, reforestation, and obligations benefiting SINAC—provided an objective basis for finding that his willingness to restore the harm had not been established. The court therefore found the refusal adequately reasoned and denied the defense appeal.El Tribunal de Apelación confirmó la condena por aprovechamiento ilegal del recurso forestal y rechazó sustituir veinte días de prisión por trabajo de utilidad pública. Determinó que, aun dentro de un procedimiento especial abreviado, las partes solamente pueden negociar la pena en los términos autorizados por el artículo 374 del Código Procesal Penal; su falta de oposición a una sanción alternativa no obliga al tribunal sentenciador a concederla. El incumplimiento previo del plan reparador de una suspensión del proceso a prueba —que incluía trabajo comunal, reforestación y prestaciones a favor del SINAC— aportó una base objetiva para concluir que no estaba acreditada la disposición del condenado para restaurar el daño. Por ello, la denegatoria estuvo debidamente fundamentada y el recurso defensivo fue declarado sin lugar.

The Criminal Appeals Court of the Second Judicial Circuit of San José heard the appeal filed by the defense of the accused and civil defendant, who had been acquitted in the criminal proceedings for illegal harvesting of forest resources but ordered to pay environmental damages in the civil claim. The appeal was granted and the judgment partially reversed. The appeals court upheld the criminal acquittal due to lack of evidence linking the accused to the felling or harvesting of trees beyond the permit. Regarding the civil damages claim, the court noted that civil liability can attach despite a criminal acquittal, but found that the causal link between the defendant’s conduct and the alleged environmental damage was not proven, nor was any theory of imputation established. No expert evidence quantifying the damage was presented. The civil claim was therefore dismissed, without awarding costs against the State given reasonable grounds to litigate.El Tribunal de Apelación de Sentencia Penal del II Circuito Judicial de San José conoció del recurso de apelación interpuesto por la defensa de la imputada y demandada civil, a quien en primera instancia se absolvió penalmente por el delito de aprovechamiento ilegal de recursos forestales pero se condenó civilmente al pago de daños ambientales. La apelación fue declarada con lugar y se revocó parcialmente la sentencia. El tribunal de apelación confirmó la absolución penal por ausencia de prueba de participación de la imputada en la tala o aprovechamiento de los árboles excedentes al permiso forestal. En cuanto a la acción civil resarcitoria, si bien reconoce que la condena civil puede proceder aun existiendo absolución penal, determinó que en este caso no se acreditó el nexo de causalidad entre la conducta de la demandada y el daño ambiental reclamado, ni se estableció un criterio de imputación (subjetivo u objetivo). Tampoco se incorporó prueba pericial que cuantificara el daño. Por ello, se rechazó la demanda civil, sin especial condenatoria en costas por existir razón plausible para litigar.

Agroforestry Exception Precludes Illegal Timber OffenseExcepción agroforestal excluye delito de aprovechamiento ilegalDeniedSin lugar

The Appellate Criminal Sentencing Court denied the Public Prosecutor’s appeal and upheld the acquittal for illegal tree cutting and timber exploitation. The six cedar and laurel trees were cut within an agroforestry system, as established by the SINAC report and testimonial evidence. The conduct therefore fell under Article 28 of the Forestry Law, which dispenses with permits for cutting, transporting, processing, and exporting timber obtained from such systems. Although the trial court confused mistake of fact with mistake of law and incorrectly understood Article 61(a) as applying only when the private land belongs to someone other than the accused, those errors did not affect the outcome because the statutory exception rendered the conduct noncriminal. The appellate court clarified that the offense may be committed even by the owner of private land. It also held that the alleged removal and transportation of the timber could not be prosecuted again because that conduct had already been conclusively dismissed and was protected by res judicata.El Tribunal de Apelación rechazó el recurso del Ministerio Público y confirmó la absolutoria por tala y aprovechamiento ilegal de madera. La corta de seis árboles de cedro y laurel ocurrió dentro de un sistema agroforestal, según el informe del SINAC y la prueba testimonial, por lo que estaba amparada por el artículo 28 de la Ley Forestal, que exime de permiso la corta, el transporte, la industrialización y la exportación de madera procedente de esos sistemas. Aunque el tribunal de juicio confundió el error de tipo con el error de prohibición y entendió incorrectamente que el artículo 61 inciso a) solo se aplica cuando el terreno privado pertenece a un tercero, esos defectos no alteraron el resultado: la excepción legal hacía atípica la conducta. El Tribunal aclaró que el delito puede ser cometido por el propio dueño de una finca privada. Además, no podía juzgarse nuevamente la sustracción y el transporte de la madera porque ese hecho ya había sido objeto de sobreseimiento definitivo.
