The Forestry Law (No. 7575) establishes the legal framework for the conservation, protection and management of natural forests and the promotion of forest resources in Costa Rica. It defines key concepts such as forest, forest plantation, forest ecosystem and environmental services. It declares the State's essential function to ensure the adequate and sustainable use of forest resources, prohibiting land-use change in forest-covered land (Art. 19) and requiring management plans for their exploitation. It creates the Forest Fund and the National Forest Financing Fund to finance conservation, reforestation and payment for environmental services programs. It imposes a 3% tax on timber and defines incentives such as the Forest Conservation Certificate (CCB). In addition, it criminalizes offenses against forest resources, including invasion of protected areas, illegal logging, forest fires and land-use change, with prison sentences and seizure of products. The law is of public order and repeals previous legislation, consolidating the Costa Rican forest regime.La Ley Forestal (N° 7575) establece el marco jurídico para la conservación, protección y administración de los bosques naturales y el fomento de los recursos forestales en Costa Rica. Define conceptos clave como bosque, plantación forestal, ecosistema boscoso y servicios ambientales. Declara la función esencial del Estado de velar por el uso adecuado y sostenible de los recursos forestales, prohibiendo el cambio de uso del suelo en terrenos cubiertos de bosque (Art. 19) y exigiendo planes de manejo para su aprovechamiento. Crea el Fondo Forestal y el Fondo Nacional de Financiamiento Forestal para financiar programas de conservación, reforestación y pago de servicios ambientales. Establece un impuesto del 3% sobre la madera y define incentivos como el Certificado para la Conservación del Bosque (CCB). Además, tipifica delitos contra los recursos forestales, incluyendo invasión de áreas protegidas, tala ilegal, incendios forestales y cambio de uso del suelo, con penas de prisión y decomiso de productos. La ley es de orden público y deroga legislación anterior, consolidando el régimen forestal costarricense.

This executive decree develops Forestry Law No. 7575, establishing operational definitions, the organization and powers of the State Forestry Administration, and detailed procedures for forest management and harvesting. It regulates forestry regencies, voluntary forest certification, transport of forest products, and protection against fires and pests. It establishes the framework for financial incentives such as the Forest Conservation Certificate and Payment for Environmental Services, including contracts, requirements, and grounds for breach. It incorporates recent amendments creating a differentiated payment approach for ecosystem services for forest protection, recognizing premiums for biodiversity and water resources, and establishes funds for sustainable development.Este decreto ejecutivo desarrolla la Ley Forestal N° 7575, estableciendo las definiciones operativas, la organización y competencias de la Administración Forestal del Estado, y los procedimientos detallados para el manejo y aprovechamiento de bosques. Regula las regencias forestales, la certificación forestal voluntaria, el transporte de productos forestales, y la protección contra incendios y plagas. Establece el marco para los incentivos financieros como el Certificado de Conservación del Bosque y el Pago por Servicios Ambientales, incluyendo los contratos, requisitos y causales de incumplimiento. Incorpora reformas recientes que crean un enfoque de pagos diferenciados por servicios ecosistémicos para protección de bosque, reconociendo pluses por biodiversidad y recurso hídrico, y establece fondos para el desarrollo sostenible.

This executive decree establishes a total and indefinite ban on the harvesting of seventeen timber tree species that are in danger of extinction in Costa Rica. The measure is based on scientific studies demonstrating the threat to these species, which are located outside protected wild areas, and seeks to ensure their protection and conservation. The decree imposes obligations on forestry professionals to include these individuals in management plans and inventories, and on owners of land where they are found to report them to the State Forestry Administration. Additionally, it creates a mechanism for trading standing trees as 'species in conservation' through the Agricultural Products Exchange (Bolsa de Productos Agropecuarios), allowing landowners to receive economic compensation without felling the trees. The ban is subject to semiannual review by the State Forestry Administration, which may extend or revoke it upon certification of sufficient population to allow sustainable use.Este decreto ejecutivo establece una veda total e indefinida para el aprovechamiento de diecisiete especies de árboles maderables que se encuentran en peligro de extinción en Costa Rica. La medida se basa en estudios científicos que demuestran la amenaza sobre estas especies, ubicadas fuera de áreas silvestres protegidas, y busca garantizar su protección y conservación. El decreto impone obligaciones a los profesionales forestales de incluir estos individuos en planes de manejo e inventarios, y a los propietarios de terrenos donde se localicen de reportarlos a la Administración Forestal del Estado. Además, se crea un mecanismo de comercialización de los árboles en pie como “especies en conservación” a través de la Bolsa de Productos Agropecuarios, permitiendo a propietarios obtener retribución económica sin talar los árboles. La veda está sujeta a revisión semestral por la Administración Forestal del Estado, que puede prorrogarla o revocarla previa certificación de suficiencia poblacional que permita un aprovechamiento sostenible.

Restriction on Timber Harvesting of Almendro TreesRestricción para el Aprovechamiento Maderable de Arboles de Almendro

Executive Decree No. 25167-MINAE, issued in 1996, imposes a total restriction on the standing timber harvesting of almendro trees (Dipteryx panamensis) within a defined geographic zone between the San Carlos and Sarapiquí rivers on Costa Rica's Atlantic slope. The measure is based on the almendro serving as the critical nesting and feeding habitat of the great green macaw (Ara ambigua), an endangered species whose reproductive population was estimated at only 25 to 35 breeding pairs at the time of the decree. The decree further prohibits the collection, destruction, or removal of great green macaw eggs, chicks, and nests, as well as hunting, capturing, or exploiting the macaw, classifying these actions as crimes. MINAE is ordered to reinforce control and supervision of forest harvests in the zone, establish compensation measures for owners of almendro forests and trees, and give priority to the zone for the issuance of Forest Conservation Certificates and the environmental services benefits established in Article 69 of the Forestry Law. The decree also prioritizes environmental education campaigns about the great green macaw's situation and inter-institutional coordination to support habitat conservation initiatives.El Decreto Ejecutivo Nº 25167-MINAE, emitido en 1996, establece una restricción total al aprovechamiento maderable de los árboles de almendro (Dipteryx panamensis) en pie dentro de una zona geográfica delimitada entre los ríos San Carlos y Sarapiquí en la vertiente atlántica de Costa Rica. La medida se fundamenta en que el almendro constituye el hábitat crítico de anidación y alimentación de la lapa verde (Ara ambigua), especie en peligro de extinción cuyas poblaciones reproductivas se estimaban entre 25 y 35 parejas al momento del decreto. El decreto prohíbe además la recolección, destrucción o extracción de huevos, crías y nidos de lapa verde, así como su caza, captura o aprovechamiento, tipificando estas acciones como delito. Se ordena al MINAE reforzar el control y supervisión de los aprovechamientos forestales en la zona, establecer medidas de compensación para propietarios de bosques y árboles de almendro, y dar prioridad a la zona para el otorgamiento del Certificado de Conservación de Bosques y los beneficios por servicios ambientales previstos en el artículo 69 de la Ley Forestal. El decreto también prioriza campañas de educación ambiental sobre la situación de la lapa verde y la coordinación interinstitucional para apoyar iniciativas de conservación del hábitat.

This Executive Decree 30961-MINAE maintains the precautionary measure ordered by the Constitutional Court in Ruling 2002-02486, requiring MINAE to verify the effectiveness of actions taken to protect the habitat of the great green macaw (Ara ambigua) and the almendro tree (Dipteryx panamensis). It suspends for nine months the receipt of applications for logging or harvesting of almendro nationwide, extendable by three additional months. It orders FONAFIFO to develop a methodology for payment for environmental services (PES) to landowners where almendro logging is denied under this decree, under the biodiversity protection modality. Trees denied for logging will be subject to PES, except those already excluded by other legal provisions (protection areas, remnant trees, etc.). It establishes that encumbrances will be registered in the Public Registry or in the Conservation Area Project Registry. It authorizes SINAC to receive donations, establish agreements and enter into contracts to fulfill the decree's purposes, including budgetary modifications. It is based on the Constitution, the Convention on Biological Diversity, and the Biodiversity, Wildlife Conservation and Forestry laws.Este Decreto Ejecutivo 30961-MINAE mantiene la medida cautelar ordenada por la Sala Constitucional en el Voto 2002-02486, que obliga al MINAE a verificar la efectividad de las acciones adoptadas para proteger el hábitat de la lapa verde (Ara ambigua) y los árboles de almendro (Dipteryx panamensis). Suspende por nueve meses la recepción de solicitudes de corta o aprovechamiento de almendro en todo el país, prorrogables por tres meses adicionales. Ordena a FONAFIFO elaborar la metodología para el pago de servicios ambientales (PSA) a los propietarios de fincas donde se deniegue la corta de almendro por aplicación de este decreto, en la modalidad de protección de la biodiversidad. Los árboles denegados para corta se considerarán sujetos a PSA, excepto aquellos ya excluidos por otras disposiciones legales (áreas de protección, árboles remanentes, etc.). Establece que las afectaciones se inscribirán en el Registro Público o en el Registro de Proyectos del Área de Conservación. Autoriza al SINAC a recibir donaciones, establecer convenios y realizar contratos para cumplir los fines del decreto, incluyendo modificaciones presupuestarias. Se fundamenta en la Constitución Política, el Convenio sobre la Diversidad Biológica, las leyes de Biodiversidad, Conservación de la Vida Silvestre y Forestal.

The Criminal Cassation Court partially annuls a definitive dismissal due to the statute of limitations on criminal proceedings, insofar as it ordered the forfeiture of timber seized for a Forestry Law violation. The trial court had ordered forfeiture and donation of the timber to the Ministry of Environment and Energy, arguing that the illegal act did occur. The cassation court holds that the lower court failed to adequately substantiate the existence of the act, its criminality, or its unlawfulness, since a dismissal based on the statute of limitations does not allow these elements to be established without a trial. Although Article 96 of the Penal Code permits forfeiture even when criminal proceedings are extinguished for items whose possession is per se prohibited, in this case the lack of factual and legal reasoning invalidates the forfeiture order. The case is remanded for a properly reasoned decision on the seized property.El Tribunal de Casación Penal anula parcialmente un sobreseimiento definitivo por prescripción de la acción penal, en cuanto dispuso el comiso de madera decomisada por infracción a la Ley Forestal. El tribunal de juicio había ordenado el comiso y la donación de la madera al Ministerio de Ambiente y Energía, alegando que el hecho ilícito sí ocurrió. La casación determina que el a quo no fundamentó adecuadamente la existencia del hecho, su tipicidad ni antijuridicidad, pues el sobreseimiento por prescripción no permite establecer estos elementos sin juicio. Aunque el artículo 96 del Código Penal permite el comiso aun extinguiéndose la acción penal cuando se trata de instrumentos cuya tenencia es per se prohibida, en este caso la falta de motivación fáctica y jurídica vicia la orden de comiso. Se ordena el reenvío para que se resuelva de manera fundada sobre el destino de los bienes decomisados.

The Criminal Appeals Court of San Ramón overturns an acquittal for violations of the Forestry Law, finding defective reasoning and errors in evidence weighing. The lower court in Ciudad Quesada had acquitted the defendant – accused of illegally transporting yellow almond wood (a protected species) and illegal logging inside a National Wildlife Refuge – on grounds of doubt. The acquittal held that the property's ownership was unproven and the seized logs could not be firmly tied to stumps on the land. The appeals chamber finds ownership irrelevant to the criminal offenses and deems that the trial court improperly disregarded the expert testimony of a MINAET biologist with 20 years of experience, whose tape-measure comparisons and field observations provided serious, precise, and unequivocal circumstantial evidence. A retrial is ordered.El Tribunal de Apelación de Sentencia Penal de San Ramón anula una sentencia absolutoria por infracciones a la Ley Forestal, al detectar falta de fundamentación y errores en la valoración probatoria del tribunal de juicio. Se revoca la absolución del imputado en Ciudad Quesada, quien era acusado de transporte ilegal de madera de almendro amarillo (especie vedada) y tala ilegal en un Refugio Nacional de Vida Silvestre. El fallo impugnado había absuelto por duda, argumentando que no se demostró la titularidad de la finca ni la coincidencia entre las trozas decomisadas y los tocones. La cámara de apelación considera que la titularidad es irrelevante para los tipos penales y que el tribunal desestimó indebidamente el testimonio experto de un biólogo del MINAET con 20 años de experiencia, cuyas mediciones con cinta métrica y observaciones de campo ofrecían indicios graves, precisos y unívocos. Se ordena juicio de reenvío.
