Maritime Terrestrial Zone LawLey sobre la Zona Marítimo Terrestre
Law 6043 declares the maritime terrestrial zone as inalienable and imprescriptible national patrimony of the State, consisting of a 200-meter strip along the coastlines. It establishes two sections: the public zone (50 meters from the ordinary high tide) dedicated to public use and free transit, and the restricted zone (remaining 150 meters) subject to municipal concessions. It regulates the roles of the Costa Rican Tourism Institute (ICT) and municipalities in planning, development and oversight of these areas. It prohibits occupation, construction and exploitation without authorization throughout the zone, with limited exceptions. It defines the concession regime in the restricted zone, including requirements, terms, fees, grounds for extinction and criminal penalties for violations. It excludes consolidated urban areas, legitimate private properties and national parks, but reaffirms state domain over islands, mangroves and marine formations.La Ley 6043 declara la zona marítimo terrestre como patrimonio nacional inalienable e imprescriptible del Estado, compuesta por una franja de 200 metros a lo largo de los litorales. Establece dos secciones: la zona pública (50 metros desde la pleamar) dedicada al uso público y libre tránsito, y la zona restringida (150 metros restantes) sujeta a concesiones municipales. Regula las funciones del Instituto Costarricense de Turismo (ICT) y las municipalidades en la planificación, desarrollo y fiscalización de estas áreas. Prohíbe la ocupación, construcciones y explotación sin autorización en toda la zona, con excepciones limitadas. Define el régimen de concesiones en la zona restringida, incluyendo requisitos, plazos, cánones, causales de extinción y sanciones penales por infracciones. Excluye áreas urbanas consolidadas, propiedades privadas legítimas y parques nacionales, pero reafirma el dominio estatal sobre islas, manglares y formaciones marinas.
