El Tribunal de Apelación había declarado prescrita la acción penal respecto de los dos primeros ilícitos, por considerar que no eran delitos de efectos permanentes. La Sala Tercera anula esa decisión y establece que ambos delitos –previstos en los artículos 58 y 61 de la Ley Forestal– son delitos instantáneos de efectos permanentes, por lo que el plazo de prescripción no inicia mientras continúe la afectación al bien jurídico tutelado. En el caso concreto, se acreditó que el camino en bosque seguía en uso y mantenimiento, y que la vegetación en el área de protección del río seguía sustituida por pasto mejorado, por lo que la afectación no había cesado y la acción penal no estaba prescrita. Además, se acoge un motivo de la defensa por falta de fundamentación del fallo de apelación al no haber verificado si la acusación contenía la descripción del dolo. Se ordena reenvío parcial para nuevo análisis sobre ese aspecto y sobre las consecuencias civiles, manteniendo la orden de restitución de las cosas a su estado natural.

También rechazó la apelación de la Procuraduría: aunque los peritajes mostraban que la zona afectada había constituido bosque, no se acreditó la responsabilidad penal ni civil del imputado, por lo que no correspondía imponerle la restauración. No obstante, ordenó comunicar la sentencia al Área de Conservación Pacífico Central, Subregión Los Santos, para dar seguimiento al sitio y adoptar, dentro de sus competencias, las medidas ambientales necesarias. El juez Fallas disintió al considerar que la restauración ambiental puede ordenarse de oficio y bajo responsabilidad objetiva, aun sin individualizar al autor del daño.

Se determinó que el testigo presencial identificó a los imputados y detalló las acciones ilícitas, que el geólogo del MINAE cuantificó el material extraído como 70 metros cúbicos (no 70 centímetros cúbicos) y que el daño ambiental fue acreditado. Además, se anuló la declaratoria sin lugar de la acción civil resarcitoria, ordenándose el reenvío para nueva sustanciación con diferente integración.

Conforme al artículo 52 de la Ley de Uso, Manejo y Conservación de Suelos, la legislación ambiental y la jurisprudencia citada, la responsabilidad civil ambiental es objetiva: puede surgir independientemente de una condena penal y de la participación volitiva del demandado. Para reclamar la reparación deben acreditarse el daño y el nexo causal, mientras corresponde al demandado desvirtuar la responsabilidad. El Tribunal anuló únicamente el extremo que declaró sin lugar la acción civil y ordenó un juicio de reenvío para resolver nuevamente la pretensión resarcitoria.

El tribunal de alzada determinó que el a quo incurrió en un razonamiento defectuoso al aceptar que los imputados fueron inducidos a error por un líder indígena que les ocultó la falta de permisos, cuando el ordenamiento jurídico no contempla permiso alguno para invadir áreas de protección. Además, no valoró adecuadamente la prueba que indicaba la participación activa de uno de los imputados como guía de la maquinaria. Se ordena el juicio de reenvío con distinta integración.
